I rarely post "Under Contract" anymore. 😅

After doing this long enough, I've learned that under contract does NOT mean sold.

In fact, we've already had 2 deals fall apart this month after going under contract. 😭

That's the side of real estate nobody talks about.

😃People see the closing photos and sold signs, but they don't always see the financing issues, low appraisals, inspection negotiations, title concerns, insurance surprises, and other hurdles that can happen between contract and closing day.

It's also why when you see a property come back on the market, don't automatically assume there's something wrong with the house. 😕Many times, the reason has nothing to do with the property itself.

🏡 Would YOU Pay the Appraisal Gap?

Imagine you're under contract to buy a home for $300,000. You've completed inspections, paid for an appraisal, applied for financing, and are getting excited about closing.

Then the appraisal comes back at $285,000. 😬

That creates a $15,000 appraisal gap—the difference between the contract price and the appraised value.

Why does it matter?

Most lenders base their loan amount on the appraised value, not the contract price. Someone has to make up that $15,000 difference before the sale can close.

Options may include:
✔️ Buyer pays the difference
✔️ Seller reduces the price
✔️ Buyer and seller meet in the middle
✔️ An ROV (Reconsideration of Value) is submitted if there are missed comparable sales, upgrades, or errors in the appraisal

One common misconception is that buyers benefit from a low appraisal. In reality, most buyers have already spent money on inspections, appraisal fees, lender fees, surveys, and other due diligence costs and are just as disappointed as the seller.

Sellers should also remember that certain loan programs, such as FHA and VA, may keep the appraisal tied to the property for a period of time. If the deal falls apart, the next buyer using the same loan type could face the same appraisal issue.

A low appraisal doesn't automatically mean the home isn't worth the contract price, and it doesn't always mean the deal is dead. It simply means the appraiser could not support that value with the market data available at the time.

💰 Real Estate Education: Earnest Money Isn't Just a Deposit

One of the biggest misconceptions in real estate is that earnest money automatically goes to the seller if a transaction doesn't close.

That's not how it works.

Earnest money is a buyer's good-faith deposit that shows they're serious about purchasing a property. The funds are typically held by a neutral third party, such as a closing attorney or title company, until closing.

What happens to the earnest money depends on the terms of the contract.

🏡 A buyer may be entitled to receive their earnest money back if they terminate under a valid contingency, such as:
✔ Financing contingency
✔ Home inspection contingency
✔ Appraisal contingency
✔ Title issues
✔ Other contract provisions

🏡 A seller may be entitled to the earnest money if the buyer defaults on the contract without a contractual reason to terminate.

Another important fact:

Earnest money is not the same as a down payment.

The earnest money is usually credited toward the buyer's costs at closing, but it serves a completely different purpose during the transaction.

Common Questions

❓ How much earnest money should I offer?

There is no magic number. The amount can vary based on:
• Purchase price
• Market conditions
• Type of property
• Negotiating strength

❓ Does more earnest money make my offer stronger?

Sometimes. A larger earnest money deposit can signal to a seller that a buyer is serious and financially prepared to close.

❓ Who holds the earnest money?

Typically a closing attorney, title company, or qualifying escrow holder—not the buyer and not the seller.

Bottom Line

Before signing a contract, make sure you understand:
✅ How much earnest money is due
✅ When it must be delivered
✅ Who will hold it
✅ What circumstances allow it to be refunded
✅ What circumstances could cause it to be forfeited

A real estate contract is much more than a purchase price. Understanding earnest money can help protect both buyers and sellers throughout the transaction.

Some clients leave a lasting impression, and this one certainly did.

😃You know when you meet someone and find yourself smiling from beginning to end? That was this entire experience.

🦞From Massachusetts to Alabama 🥜 , we are so proud to officially welcome our client as an Alabamian! ❤️

💗After a lifetime of memories, experiences, and an incredible life in Massachusetts, he made the decision to call Alabama home so he could be closer to his children and family who have relocated to the area. While he'll always cherish his roots, he's looking forward to enjoying retirement surrounded by the people he loves most.

He was an absolute joy to work with and get to know. He reminded me a lot of the good men in my life—my Dad and my husband—honest, genuine, and always a pleasure to be around.

And in true fashion, his very first priority after getting the keys was making sure his lobster made it safely into the refrigerator! 🦞 He laughed and said, "It's only right to have lobster my first night in my new house." A little piece of Massachusetts in his new Alabama home.

Spent the afternoon pulling deeds trying to track down an easement. Let’s just say it was about as easy as finding a needle in a haystack. 🤦🏼‍♀️📜

Somewhere along the way, we found ourselves looking at deeds from the 1800s. The handwriting was beautiful… but let’s just say penmanship standards were a little different back then. 😂

Mike and I have pulled plenty of deeds online over the years, but this was our first time digging through archived records from the 1930s and 1970s trying to connect all the dots. It definitely gave us a whole new appreciation for title work and surveyors.

A special shoutout to Jimmy Davis with Davis Surveying. When we hit a roadblock, one phone call to Jimmy and his knowledge was invaluable. After today, we’re convinced surveyors are part surveyor, part historian, and part detective. 🔎

Of course, all that hard work required a lunch break at The Dime Store in Clayton. A fried bologna sandwich and sweet tea can solve a lot of problems… just not missing easements. 🥪😂

💡 Tip of the Day: If you have a survey completed, make sure any easements and legal access are clearly shown on the survey and properly referenced in your deed. It can save someone a whole lot of time digging through decades of courthouse records trying to find a missing piece of the puzzle!

Real estate is never boring. Every day brings a new adventure, and today felt a little like an episode of Property Detectives.
