June is peak turnover season. And every summer, landlords show up to Small Claims Court or Oakland RAP hearings with solid evidence of real tenant damage โ€” photos, receipts, the works โ€” and lose the deduction anyway.

Not because the damage wasn't real. Because they never made the written offer.
California law requires you to offer your tenant a pre-move-out inspection in writing before they leave. Once notice to vacate arrives, that same day, you need to send a written offer for a walkthrough under Civil Code ยง1950.5(f).

The inspection gives the tenant a chance to fix deficiencies before they go. If they fix it โ€” you can't charge for it. If they don't โ€” you can. If you never offered it โ€” you may forfeit the deduction entirely.
