Richmond landlords: if you're used to Richmond's rent cap running a little higher than Oakland's, that's not true anymore.

Last cycle, Richmond's AGA (1.62%) beat Oakland's (0.8%) โ€” close enough that rounding a Richmond unit up to Oakland's rate barely cost anything. This cycle, that flipped. Oakland's cap rose to 2.3%. Richmond's dropped to 1.5%. Apply the old assumption now and you're over Richmond's cap โ€” which a tenant can challenge.

๐Ÿ  A myth we hear constantly from Berkeley landlords: that just-cause eviction protection doesn't apply until a tenant has lived in the unit for 12 months.

That's not how it works. Berkeley's just-cause ordinance (BMC 13.76.130) has no occupancy minimum โ€” it applies from day one of any covered tenancy, full stop.

Oakland, Berkeley, Richmond, and Emeryville each run their own rent-control system โ€” different rates, different registration deadlines, different just-cause eviction timing. Mixing them up is one of the more common (and costlier) mistakes we see in multi-city portfolios.

In this week's video, we break down when Civil Code ยง1946.1's no-cause notice still works, when AB 1482's just-cause rule (and its added-tenant wrinkle) takes over instead, and why Oakland, Berkeley, and Emeryville landlords almost never get a true no-cause option. Think a new Berkeley tenant can get their first rent increase after 12 months? Not quite.

Berkeley blocks any AGA increase for the rest of the calendar year a tenancy starts in โ€” plus the entire following year. A tenancy that starts in March 2026 doesn't see its first increase until 2028. We flag every new Berkeley move-in date specifically so it's never missed.

A lot of landlords reach for the 30/60-day notice statute โ€” that's actually the wrong one. Civil Code ยง827 governs a rent increase on a month-to-month tenancy, and the cap for 2026โ€“2027 is 8.8% statewide, but far lower locally: 2.3% in Oakland, 1.0% in Berkeley, 1.5% in Richmond.
