Not all deeds offer the same protection—and this is something every Florida buyer should understand before closing 🏡

Let’s break it down:

A warranty deed gives the buyer the strongest level of protection. It guarantees that the seller has clear title and the legal right to sell the property. This is what you’ll typically see in traditional real estate transactions with title insurance.

A quitclaim deed, on the other hand, transfers ownership with zero guarantees. It simply says, “Whatever interest I have, if any, I’m giving to you.” That means there could still be liens, claims, or ownership issues attached to the property.

Quitclaim deeds are commonly used for:
• Divorce settlements
• Transfers between family members
• Moving property into a trust or LLC

Important note: just because someone signs a quitclaim deed does NOT mean the title is clean—or that it can even be insured.

That’s why understanding the type of deed matters just as much as the price or location.

Many people assume their home automatically goes to their children or closest family members when they pass away. In Florida, that’s not always how it works.

If someone dies without a will, their property will typically have to go through probate—a legal process where the court determines who inherits the estate. During that time, the property often can’t be sold, transferred, or refinanced until the probate process is complete.

Depending on the situation, probate can take months (or longer), and if multiple heirs inherit the property, everyone generally needs to agree before a sale can move forward.

Florida homestead properties also have unique inheritance laws and protections that can affect who receives the home and what can be done with it after an owner’s passing.

This is one of those situations where a little planning today can save your family a lot of stress and delays down the road.
