What Is the Virginia Residential Landlord and Tenant Act (VRLTA)?

Many Virginia landlords are governed by a law they don’t fully understand.

If you own or manage a rental property in Virginia, chances are your lease is governed by the Virginia Residential Landlord and Tenant Act (VRLTA).

This applies to most residential rental properties across Northern Virginia, including Fairfax County, Loudoun County, Arlington County, Prince William County, Reston, Herndon, McLean, Vienna, Oakton, Falls Church, and Chantilly.

The VRLTA establishes the legal rights and responsibilities of both landlords and tenants and applies to the majority of single-family homes, townhouses, condominiums, and multifamily properties in Virginia.

One requirement I see overlooked far too often is the Statement of Tenant Rights and Responsibilities.

Under Β§ 55.1-1204 of the VRLTA, landlords must provide this document to tenants and obtain their signature. Without it, a landlord may be prevented from enforcing a lease violation in court, even when the lease itself is valid.

This is one of several reasons landlords should avoid generic or out-of-state lease templates and rely on Virginia-specific, VRLTA-compliant lease documents, along with properly drafted addenda when needed.
