Kris Mayes is investigating complaints that landlords are illegally charging tenants fees equivalent to the rental tax, which was banned by a Republican-backed law effective January 1. Tenants have reported that their rent has not decreased as expected, with some landlords allegedly disguising the former rental tax as new fees.

Mayes' office has already issued a cease-and-desist letter to Tradelands LLC, a Mesa-based property management company, for charging tenants at the Madrid Courtyard Apartments an "administrative fee" that investigators determined was a rebranded rental tax. Tradelands has since eliminated the fee and promised refunds to affected tenants. While landlords must prove in court that new fees are not replacing the rental tax, the law lacks specific penalties for violations, prompting further scrutiny by Mayes’ office.
