It’s vacation season so updates are a little slower than usual, but we can finally report that the Class Action has been officially certified by the court.
Next, each association within Palm Aire will receive a subpoena as follows:
IN ORDER TO PROVIDE NOTICE TO THE CLASS MEMBERS, THE CLASS PLAINTIFFS MUST OBTAIN THEIR CONTACT INFORMATION. THIS SUBPOENA SEEKS SUCH INFORMATION FOR THE SOLE PURPOSE OF PROVIDING NOTICE OF THE CLASS
ACTION TO THE CLASS MEMBERS
1. The "current roster of all unit owners and their mailing addresses,..." maintained
under Fla. Stat. § 718.111(12).
2. The "e-mail addresses of unit owners consenting to receive notice by electronic

The long and short of it all is that the lawsuit is moving forward as a Class Action and every homeowner in Palm Aire will be notified. This reality should put to rest once and for all the false narrative that this lawsuit is merely the caprice of a handful of homeowners.
