A Buyer Representation Agreement (BRA) is a legally binding document that formalizes the working relationship between a buyer and their real estate agent. It outlines the agent’s duties and compensation, the buyer’s responsibilities, and ensures both parties are clear on expectations throughout the home-buying process.

As of August 17, 2024, this agreement became legally required to ensure transparency and accountability in real estate transactions. The goal is to protect buyers by requiring agents to fully disclose their fiduciary duties, including loyalty, confidentiality, and acting in the buyer’s best interests. It also clarifies compensation structures and prevents misunderstandings about the agent’s role.

Key Benefits of a Buyer Representation Agreement:

• Exclusive Advocacy: Your agent is legally obligated to prioritize your needs and negotiate on your behalf.
• Clear Terms: It sets clear boundaries, such as the duration of the relationship, property types, and geographic areas covered.
• Mutual Commitment: Both parties commit to a collaborative effort in finding the right property.

Your Right to Terminate:

The agreement includes protections for buyers, allowing you to terminate the agreement for just cause. If, for example, you feel your agent is not fulfilling their duties or providing the service promised, you have the right to end the relationship. This ensures that buyers maintain control over who represents their interests.
The agreement also states terms of protection for the REALTOR. If the buyer goes under contract on a specific home that was shown to them by the agent. The agent is entitled to compensation for their work already done. This prevents buyers from using agents without compensating them.
Now, there is a document that can be completed for “showing services” only in which the buyer pays the agent a fee determined by the agent to show only. In a show only situation, the agent receives upfront payment from the buyer in a form of payment written to the broker for SHOWING SERVICES.

This means that before you start viewing homes, it's crucial to sign a representation agreement with your broker. This signed agreement not only formalizes the relationship between you and your agent but also clarifies the responsibilities and expectations for both parties.

Being informed about these changes ensures that buyers are better prepared for the home-buying process. Make sure to communicate openly with your agent about any questions or concerns regarding this new protocol.
