GREAT NEWS for sellers:

WA SB 6091
This week, our governor signed WA SB 6091 into law, with it set to go into effect starting June 11, 2026. This law affirms what we have been saying all along: homeowners should be free to publicly market their homes before listing them on the MLS or portals. Specifically, the law prohibits a broker from marketing residential real estate "to a limited or exclusive group of prospective buyers or brokers" and requires that "the real estate is concurrently marketed to the general public and all other brokers."

What This Means for You
Crucially, the new state law does not mandate submitting listings to MLSs or portals and explicitly confirms that broad home marketing is permissible before listing on the MLS or portals. Our Legal team is also confident that both Compass Private Exclusives and Compass Coming Soons are compliant with this new law because:
Compass Coming Soon listings are fully accessible to all buyers and agents on Compass.com and Redfin.com. These listings adhere to all state regulations and Zillow's guidelines. Specifically, Coming Soons are “marketed to the general public and all other brokers” and “broadly accessible to the general public in a manner that provides open access.”
Compass Private Exclusives are off-MLS, off-Zillow, and off-internet listings that are also available to anybody. On Compass.com, search results clearly notify all users, including non-Compass agents and their clients, about the number of Compass Private Exclusives that match their criteria. The site provides explicit instructions on how to access these listings in a prominent black box that says: “Listings are only private online. All buyers and agents can access in our offices or by contacting Compass.” Additionally, any client and any agent from any brokerage can receive automatic alerts for Compass Private Exclusives.
