The National Association of REALTORS recently settled a class action lawsuit concerning real estate commissions, pending court approval, which is expected around mid-July. A key aspect of the settlement is that sellers will no longer be mandated to offer buyer agent compensation through the MLS system. Instead, buyers will need to engage with an agent under a written Buyer Representation Agreement, similar to a Listing agreement for sellers.
This does not imply that buyer's agents won't be compensated. Buyer's agents will still be compensated, either directly by the buyer or through negotiation with the seller in the offer agreement. The advantage of the seller paying the fee is that the commission becomes a transactional cost that can be financed by the buyer, similar to how agents are typically compensated in real estate transactions. Ultimately, each transaction will involve a unique negotiation on who pays the real estate commissions and how they are integrated into the deal. If you are considering buying or selling, it might be beneficial to explore these changes further to understand how they may impact your real estate transactions.
