🏡💡 Real Estate Myth Busting: “My spouse isn’t on the deed, so they don’t need to sign anything.” 💡🏡

Not always!

One of the most common questions we hear is:

👉 “Why does my husband/wife have to sign the deed if they don’t even own the house?” Or “Their opinion doesn’t matter, they aren’t on the deed.”

In Pennsylvania, a spouse may be asked to sign closing documents even if their name has never appeared on the deed. They’re typically not signing because they’re an owner—they’re signing to release potential marital rights or claims that could affect the property’s title.

Here’s where it gets interesting:

🏠 A husband inherits a house from his parents.
🏠 The wife is never added to the deed.
🏠 Years later, the house is sold.

Many people are surprised to learn that the title company may still require the wife to sign certain closing documents before the sale can move forward.

And here’s the part that really catches people off guard:

❗ A spouse who isn’t on the deed can sometimes create a title issue by refusing to sign.

That doesn’t automatically mean they own the property, but it can mean the title company won’t insure the transfer, which can delay—or even derail—a closing.

Real estate transactions are full of details like this that don’t come up until you’re already under contract. That’s why having experienced professionals involved matters. Sometimes the biggest hurdles aren’t the ones anyone sees coming.

As always, every situation is unique, and questions involving ownership, title, estates, and marital rights should be reviewed by the title company or an attorney.

Picture it:

A beautiful house appears online for rent.

The price is suspiciously low.

The “landlord” is conveniently out of town.

They just need a small deposit before you can see it.

Cue the ominous podcast music. 🎶😳

Unfortunately, rental scams like this are becoming more and more common. Scammers steal photos from legitimate real estate listings and advertise properties they don’t own, hoping someone sends money before realizing the property was never available for rent.

Before you send a deposit, application fee, or personal information:

🕵️ Verify who owns or manages the property.
🕵️ Be skeptical of prices that seem too good to be true.
🕵️ Never send money before seeing a property and confirming it’s legitimate.
🕵️ When in doubt, call a local real estate professional.

As someone who listens to way too much true crime, I’d much rather prevent a victim than listen to a story about one.
