The Texas Real Estate Commission is very clear under Rule 537.11—license holders may NOT engage in the unauthorized practice of law.

And it’s not just a general warning… it gives specific examples of what you cannot do when working with contracts 👇

🚫 Draft your own legal clauses or rewrite contract language
🚫 Add terms that go beyond what the form allows
🚫 Give legal advice or interpret legal consequences for clients
🚫 Use forms in a way they weren’t intended to be used
🚫 Create “custom contracts” outside of approved TREC or attorney-prepared forms

Real talk:

According to the Texas Real Estate Commission Rule 537.64:

👉 There’s a specific addendum—TREC No. 57-0 (Non-Realty Items Addendum)
👉 It’s approved for voluntary use
👉 And it’s designed to cover personal property NOT already listed in Paragraph 2 (Property)

So what does that actually mean in the real world? 👇

Think about items like:

Refrigerators (not built-in)
Washers & dryers
TVs, mounts, or furniture
Outdoor equipment, sheds, or tools

If it’s not automatically part of the real property, and you want it included in the deal… this is the form that protects everyone.

Real talk:
Verbal agreements about personal property are where deals go sideways fast.
If it’s not in writing—it doesn’t exist.

Bottom line:
Use the Non-Realty Items Addendum when needed so you avoid confusion, protect your client, and keep the deal intact.

💡 Did You Know? (KW Central Texas)

Yes—TREC requires you to use their contract forms… but there ARE a few key exceptions most agents forget.

According to the Texas Real Estate Commission under Rule 537.11, you may use something other than a TREC form in specific situations 👇

👉 When you are acting as a principal (not representing a client)
👉 When the U.S. Government requires a different form
👉 When the property owner provides a contract or requires one prepared by an attorney
👉 When no TREC form exists, and you use one prepared by a Texas-licensed attorney or a trade association working with one
👉 When using certain Broker-Lawyer Committee (BLC) forms approved for voluntary use

Sounds like flexibility… but don’t get it twisted 👇

Real talk:
These are exceptions—not loopholes.

If you’re acting as an agent in a standard transaction, you’re still expected to use TREC-promulgated forms. Misusing these exceptions is how agents end up in compliance issues fast.

Bottom line:
Know the rules, know the exceptions, and know when to stay in your lane—that’s how you protect your license and close more deals without problems.
