Myth: when a tenant moves out, the landlord can recarpet and repaint the whole place and take it out of the deposit.

Fact: in Colorado, not without a lot more. A landlord can't keep deposit money to replace carpet or repaint throughout the unit unless there's substantial, irreparable damage beyond normal wear and tear that wasn't there before the tenancy. And if the carpet hasn't been replaced in the last 10 years, it can't be treated as substantially and irreparably damaged at all.

If you manage rentals or help landlord clients, this one matters: the deposit comes back within 30 days (or up to 60 if the lease says so), and anything kept needs a written explanation. Miss that, and the landlord can lose the right to keep any of it.

That's one small piece of what Attorney Damien Zumbrennen covers in Overview of Colorado Tenant & Landlord Law:

It's Back to the Future Day. If you could go back and give rookie-you one piece of real estate advice, what would it be?

Mine: Ask the question. Get the clarity. Because nodding like you understand and then Googling it in your car is NOT a business strategy. 😂

Drop yours below. I read every answer, and I have a feeling the newer brokers in our community are going to want to save this thread. :)

Tomorrow: the class that makes estate listings make sense.

Probate files can be some of the most meaningful work you do, helping a family through a hard season. They go so much smoother when you know the process. You'll walk away knowing:
• How property passes: joint tenancy, beneficiary deeds, trusts, and probate
• How Colorado probate works and how long it really takes
• When the Personal Representative can sign the listing and the contract, and who signs at closing
• What the title company will ask for, including out-of-state estates
• The common title traps, and how a little planning prevents them

Nobody gets into real estate hoping to find out what a deposition feels like. Let's keep it that way.

Most brokers only learn how a lawsuit works when they're in one. This class flips that. You'll walk away knowing:
• What counts as a "claim," and when to call your E&O carrier (it may be sooner than you think)
• How the mediation clauses already in your contracts can head off a lawsuit
• How a case really moves: service, answer, discovery, trial and appeal
• Why the Colorado Attorney General is more involved in real estate than ever
• The everyday habits that get brokers sued, and the ones that keep you out of court

They set up a living trust years ago. The house still has to go through probate. Here's how that happens.

A trust only controls what's actually in it, and the house has to be deeded into the trust. It's one of the most common do-it-yourself pitfalls Attorney Michael Smeenk sees, right alongside:
• A deed to a trust or company that doesn't actually exist
• The wrong grantee on the deed
• Property that was never put in joint tenancy when everyone assumed it was

And it's not rare. A 2026 Trust & Will survey found 56% of U.S. adults have no estate plan at all, which means many of the estate listings you'll take will land in probate.

The broker who spots this on day one (pull the vesting deed!) saves the family weeks of surprises. Learn what to look for in Probate & Trust Estates, Wed Oct 21, 9:00 AM – 12:00 PM, 3 CE credits.

⚠️ Content warning: the following listing remarks may be scary for brokers. 👻

"Central air conditioning."
"Borders open space."

They sound harmless. But if the "central air" turns out to be a window unit, or the "open space" turns out to be land that can be developed, those few words can turn into a very expensive conversation.

Misrepresentation in advertising is one of the "easy ways to get sued". Attorney Jordan C. May walks through it in Anatomy of a Lawsuit. My favorite rule from his list: When in doubt, get it out. Disclose the "bad stuff" in writing, and only advertise what you've verified.

Before you hit publish on your next listing, read your remarks the way a buyer's attorney would.

You have the listing. An unrepresented buyer wants to make an offer. Now what?

Seller's agent with the buyer as a customer? Transaction broker for both? Refer the buyer out? Each one can be right, and each one comes with its own rules, paperwork and risk. And since HB26-1426 took effect Aug 12, "default" transaction brokerage isn't what it used to be.

In this NEW class you'll walk away knowing:
• The five ways to handle a double-ended deal, and when each fits
• What your listing contract and the Change of Status form need to say
• Real Colorado cases that show where brokers win and lose
• Three questions that keep you in your lane

Quick question, and be honest: have you taken your 2026 Annual Commission Update yet?

If the answer is "not yet," you're not alone, and you've still got time. But here's what I want every broker to know:
✔️ The ACU is required every year.
✔️ Once a year's ACU is gone, it can't be made up. (Renewing 12/31/2026? The Division wants your 2024, 2025 and 2026 ACUs.)
✔️ CE has to be done by December 31. The renewal grace period does not cover CE.

Knock it out this Tuesday:

Can't make the 20th? We have more ACU dates on the calendar through December.
Other ACU dates (if anyone asks): Oct 27, Nov 3, Nov 10, Nov 12, Nov 18, Dec 2, Dec 9, Dec 10, Dec 17. All dates: https://www.educatedminds1.com/featured-live-calendar/

Probate has its own vocabulary. Here are 5 words that will make your next estate listing go smoother. Save this one.

1. Personal Representative (PR): the person the court appoints to act for the estate. Being named in the will isn't enough on its own.
2. Letters: the court document that proves the PR's authority (Letters Testamentary with a will, Letters of Administration without one).
3. Personal Representative's Deed: how the estate conveys the property to your buyer.
4. Beneficiary deed: a deed recorded during the owner's life that can pass the home at death without probate.
5. Ancillary probate: when the PR was appointed in another state, a Colorado court has to recognize their authority before they can sell Colorado property.

Attorney Michael Smeenk explains how each one shows up in a real transaction in Probate & Trust Estates.
