Zillow The claims are shocking.

Hagens Berman, the same powerhouse law firm leading the antitrust case against NAR, is now suing Zillow over its “Zillow Flex” program.

According to the lawsuit:

• Zillow funnels buyers to “Flex Agents”
• Those agents secretly owe 40% of their commission back to Zillow
• Buyers are told the agent is free and unbiased
• Meanwhile, the public has no idea Zillow is getting paid behind the scenes
• And the agents themselves walk away with as little as 1% after broker fees and Zillow’s cut

Even worse?
Buyers are being tricked into signing a “Zillow Touring Agreement” that promises no fees — but locks them into the agent Zillow chose.

Meanwhile… the MLSs? Still arguing over data standards. NAR? Still forming committees.

We’ve been saying it for years — they move like dinosaurs. And today’s news? 🦕 Proof.

By contrast, MLSs and the National Association of Realtors (NAR) are often constrained by:

Legacy infrastructure — Many MLSs run on older systems that don’t easily support real-time API integrations or AI tools.

Fragmentation — There are hundreds of MLSs in the U.S., each with its own rules and data access protocols.

Policy lag — Innovation tends to move slower due to governance, compliance, and data ownership concerns.

This creates the perception that MLSs and NAR are “dinosaurs,” as you put it — slow-moving compared to agile tech giants like Zillow, who can innovate quickly and control the narrative.
