💀 Real Estate Facts That’ll Give You Chills 💀

In Arkansas, a seller could legally sell you:
🩸 A house where a violent crime happened
👻 A home with a famous ghost story
📰 A property with a past that made the headlines

…and they don’t have to tell you.
Why? Because “psychological” defects aren’t considered material facts in Arkansas, so they don’t have to be disclosed.

The only way to find out? Ask the right questions… or check with the neighbors. (They always know.)

Y'all know I'm a history nerd. I find it fascinating that we have records of land ownership for 200+ years! Being informed about the history of plots of land has given insights that have led to sales. Who said paying attention in history class was a waste of time? Let me share a piece of history that boggles my mind:

In 1803, President Thomas Jefferson signed off on what critics called a reckless gamble—the Louisiana Purchase. He DOUBLED the size of the United States, scooping up 828,000 square miles of wilderness for about 3 CENTS an acre!

At the time, many thought it was too much money for swamps and untamed frontier. But that gamble paid off in ways no one could imagine. One of the territories created from that deal? Arkansas. By 1819, Arkansas was officially organized as a U.S. territory, setting the stage for the communities we call home today. Do you think Jefferson struck a bargain?

And here’s a piece of trivia many don’t know: in 1815, surveyors came to eastern Arkansas to start mapping out this new land. They drove a stake into the ground in a swamp, known as the Initial Point. That marker became the very starting line for dividing and describing land across the frontier. To this day, property boundaries here still trace back to that very point in Arkansas soil!

Friends, it’s tempting to look at property on a nice, sunny day ☀️, but prudent buyers look at property in its worst condition 🌧️.

Put on your rainboots 🥾 and keep an eye out for drainage issues 💧, soil erosion 🌱, and wet foundations 🏚️!

“Do I have to tell the buyer my roof leaks if it only leaks when it rains?”🤔

Yes. Yes, you do.

In Arkansas, if it’s something a reasonable person would want to know before buying — it’s a material fact.

That means…

A basement that smells like a swamp after a storm 🌧️

A kitchen where the oven doubles as a mouse Airbnb 🐭

A deck that feels like a trampoline 🎢

Bottom line: If you wouldn’t hide it from your best friend, don’t hide it from your buyer. Honesty is the best policy!

🚫 Overused Real Estate Terms (and What They Really Mean) 🚫

Dream Home 🏡 → Might be your dream… might be your nightmare.

Cozy 🪵 → Small. Really small. The kitchen sink might be in the living room.

Charming 🪞 → Hasn’t been updated since 1974, but hey — crown molding!

Investor Special 💸 → Needs so much work, the dumpster out front will be your first purchase.

Here's the thing. I don't mind using ideal adjectives for describing property, but call it what it is. Your ✨Luxury ✨ listing that has granite counters older than memaw and costs less than the median sales price isn't luxury!

Many buyers walk away when they hear the words “floodplain” — but not all flood zone land is created equal. 🌊

🗺 FEMA maps show flood risk, but “flood zone” doesn’t always mean high risk — it can range from a rare, once-in-a-century chance to areas that see seasonal high water.

💡 Key things to know before you rule it out:

Insurance: Lenders may require flood insurance — costs vary by zone.

Potential Use: Pasture, hunting, recreation, and certain types of development may still be possible.

Resale: Some buyers will pay less for flood zone land, but others see opportunity.

A knowledgeable Realtor (hi 👋) can help you read FEMA maps, check local records, and figure out if a property’s floodplain status is a deal-breaker — or a hidden deal-maker.
