Some foreclosure-rescue operators make powerful promises to homeowners under financial pressure: “We can save your home.”

Before you trust that promise, ask who is actually reviewing your case, whether you can speak directly with the responsible attorney, what the proposed strategy really is, and what happens if it fails.

A legitimate solution should be based on your actual mortgage, income, property value, equity, and available time, not just a sales pitch.

Selling a property during financial distress does not always mean a short sale.

If the home can be sold for enough to pay the mortgage, other liens, and normal closing
costs, the homeowner may have an equity sale.

And that remaining equity can be significant.

It may help pay other obligations, fund relocation, create an emergency reserve, and give the homeowner a chance to rebuild financially after the housing problem is resolved.

If the property is worth less than the amount needed to close, then a short sale may need to be considered.

A lender-approved short sale can resolve the mortgage default through the closing.

Depending on the lender, investor, and program, relocation assistance may also be available.

The important point is timing.

Selling should be evaluated before foreclosure takes away the homeowner's time, equity, and choices.

Lawyers Realty Group can review both the legal issues and the real estate options to devise a path forward that is the most financially advantageous.

Financial trouble often starts long before foreclosure.

That is exactly when homeowners begin hearing promises from organizations offering foreclosure prevention, loan modifications, principal reductions, or other ways to “save” the property.

Before relying on any of those promises, ask a more important question:

Has anyone independently reviewed whether keeping the home is actually realistic?

You should know who is reviewing your situation, whether you can speak directly with the attorney responsible for the advice, and what happens if the proposed solution fails.

A legitimate review should look at the mortgage, the arrears, the property value, available equity, and whether the proposed payment is truly sustainable.

Before you trust a promise, get an independent all-options review free of charge.

Lawyers Realty Group is a California attorney-owned real estate brokerage that reviews the legal and real estate issues together to help homeowners make important decisions.

You inherited the house. But someone else is still living there. Now what?

This happens more often than families expect.

An owner passes away. A relative, caregiver, partner, or other person remains in the property. The estate or successor needs to sell, but the occupant does not want to leave.

Immediately filing a lawsuit is not necessarily the best first move.

In one matter handled by Lawyers Realty Group, a relative remained in a property after the owner passed away but did not own the property. A negotiated resolution, including relocation assistance, allowed the occupant to move and the property to proceed toward sale.

That is where the combination of legal and real estate experience can matter.

The objective is not simply to "win" a dispute. It is to find the most effective path to recover possession, protect the property's value, and get the transaction closed.

If an inherited California property cannot be sold because someone remains in possession, call (949)613-5918 for a free legal analysis of your situation or visit www.lawyersrealtygroup.com .

Someone moved into your vacant property and now claims they have a lease. Can you still sell the house?

A disputed occupant can quickly turn a normal real estate transaction into a legal problem. The first step is determining what rights actually exist, whether the documents are legitimate, and what must happen before the property can be delivered to a buyer.

Depending on the circumstances, the solution may involve negotiation, a voluntary move-out agreement, or legal action.

At Lawyers Realty Group, our attorney-Realtor approach coordinates the legal issues with the ultimate goal of getting the property sold and closed.

Some homes don't just need to be listed. They need to be untangled before they can be sold. Call (949)613-5918 or visit www.lawyersrealtygroup.com for a free legal analysis of your situation.

Someone else is living in your property. They refuse to leave. Can you still sell the house?

Maybe. But before putting the property on the market, you need to know what rights that person actually has.

They might be a tenant. They might be a family member who stayed after an owner died. They might claim an agreement that you dispute. Or they may have no legitimate right to possession at all.

The important question is not what they call themselves. It is what rights they actually have and what needs to happen before the property can be delivered to a buyer.

At Lawyers Realty Group, we approach these situations from both sides of the problem: the legal issues affecting possession and the real estate transaction needed to ultimately sell the property.

Sometimes the answer is negotiation. Sometimes a carefully structured relocation agreement makes economic sense. Other situations may require legal action.

Some homes don't just need to be listed. They need to be untangled before they can be sold.

Some foreclosure postponement schemes work by transferring a tiny fractional interest in a homeowner’s property to an unrelated person in bankruptcy. The deed may be used to create an apparent automatic-stay issue and delay the trustee’s sale.

But the delay may be temporary.

The deed can remain in the public title record for years, leaving unfamiliar names on title and blocking a refinance, reverse mortgage, trust transfer, or sale.

If you signed foreclosure-postponement documents you did not fully understand, review your title before the next transaction is already underway.

Did a foreclosure postponement company ask you to sign a grant deed, quitclaim deed, trust document, or “temporary transfer”?

Did you pay recurring fees each month to keep the trustee’s sale delayed?

Does your title report now list people, trusts, or companies you do not recognize?

These may be warning signs of a bankruptcy foreclosure postponement scheme.

Other red flags include:

• Tiny ownership interests, such as 1/100th
• New paperwork each time a bankruptcy case ended
• Promises that the transfers were temporary
• Demands for more money to remove names from title
• A title company refusing to insure a refinance or sale

Do not sign more documents without first understanding what has already been recorded.

A foreclosure rescue company promises to postpone the sale.

You pay a monthly fee.

You sign documents you do not fully understand.

A tiny interest in your home is transferred to someone in bankruptcy.
The foreclosure may be delayed, but the deed remains recorded.

The scammer sells time.

The county recorder keeps the receipt.

Years later, the damage may surface when you try to refinance, obtain a reverse mortgage, transfer the home into a trust, or sell.

If your title report now shows unfamiliar names or fractional ownership interests, Lawyers Realty Group can help evaluate the problem and the path toward clean, insurable title.

Call (949) 613-5918 or visit www.lawyersrealtygroup.com.

You stopped the foreclosure. Then, months or years later, you pulled a title report and found people you have never met listed as owners of part of your home.

That may be the aftermath of a bankruptcy foreclosure postponement scheme.

In some cases, a small fractional interest in the property is transferred to an unrelated person in bankruptcy. The deed is then used to create an apparent automatic-stay issue and delay the trustee’s sale.

The delay may be temporary.

The title problem may last for years.

If unfamiliar names, trusts, or entities appear on your property title, do not wait until a refinance or sale is already in escrow.
