It is important to have copies of notices sent to both the lease manager and a separate representative. Recently, a client was sent a legal notice. LL copied IN/House as noted in the Lease. We immediately scanned and pdf’d the document and sent it to client. Issue was resolved favorably but still, a week later, the notice has not been received by the client. If not for the copy???? Who gets back-up copies of your notices?

No one ever paid attention to the Force Majeure in a lease...until Covid 19 hit. In March, 2020, I added language to an AIR lease to address pandemics that was acceptable to all parties. Now the AIR has an Addendum that should be attached to every lease using their forms. Here's a great article for CoStar Group about the past, present and future of Force Majeure clauses.

Thank you to Marie DiSante and Thomas Song of Labor Lawyers for responding to my question about disinfecting workplaces after an employee has Covid-19. This is from the CDC and follows what we discussed with the Property Manager. “If more than 7 days since the person who is sick visited or used the facility, additional cleaning and disinfection is not necessary. Client had an employee who tested positive for Covid-19. Everyone immediately quarantined for 10 days. But what do you do about the office? Most all property managers confirmed they typically charge tenants for a Level 3 cleansing of the common areas on the multi-tenant floor. Cost is about $1.35/SF (usable…not rentable). If the office is left vacant for 10+ days, there are options. The janitors can come in and do their regular cleaning after 10 days (per CDC guidelines). If you want to return earlier, a Level 1 or 2 cleaning can run $.15-$.20/SF would be highly recommended. Still uncharted territories as to who is responsible for the cost of disinfecting. Each case may be different. Feedback?

Still waiting for your security deposit to be returned? Know your rights. States have different laws as to procedures and timing for returning security deposits. Some states only address residential leases. Check your lease. Typically, a deposit should be returned in no more than 30 days. LL's have the right to give you an option to repair damage or have it deducted from the deposit but they must notify you of the damages. If not received in a timely manner, there could be penalties.

Are you in an industrial building paying NNN or CAM charges? But what is included and are being double charged? A client was going through a PPP audit and we found that they were paying for one line item directly to a vendor but they were also paying for that same item monthly to the LL as part of the NNN charges. OOPS! A $10K overcharge. Check your charges.
