Here we go again...

As of right this moment, the new FinCEN reporting rule is vacated nationwide. If this follows a similar path to other reporting/financial regulation cases, this ruling will be stayed on appeal. As of this moment, though, we're kind of in limbo waiting on directions from the powers that be. Stay tuned.

Texas court orders FinCEN rule to be vacated

The U.S. District Court for the Eastern District of Texas agreed with a Texas title agency in Flowers Title Company v. Bessent that the Financial Crimes Enforcement Network’s (FinCEN) new residential reporting rule is unlawful and ordered the rule be vacated.

The court said the final rule exceeds FinCEN’s statutory authority under the Bank Secrecy Act.

Start educating your investor clients now (LLC, Trust) regarding the new FinCEN rule. And to be clear, "all-cash" also includes hard money, private financing, seller financing, funds from a line of credit secured by another property...basically any financing source that does not have its own NMLS # and an AML (Anti Money Laundering) Department. This affects all 1-4 family residential real estate CLOSED on or after December 1, 2025, regardless of the date of contract.

We don't often post reviews, cause it feels like bragging, but this is one we couldn't pass up sharing. Remote buyer and seller, buyer was represented by counsel and a fantastic Realtor, and did not choose to work with us. We just came along with the contract as the seller got to pick. To have someone take the time to offer us a little praise, especially when they didn't choose us, is kinda the best!
