FinCEN Update
Due to recent rulings regarding the FinCEN Residential Real Estate Rule (RRER), effective today, March 24th, Brabazon Title Team Group will stop collecting the information required. We will continue to monitor the litigation and notify you of any future procedural changes.
Although the future remains uncertain, businesses and individuals purchasing residential property through a legal entity or trust without financing should be prepared to provide information that may be needed for reporting if the RRER is reinstated.

Have you heard the latest FinCEN news?

A judge in the Eastern District of Texas issued a ruling vacating the FinCEN Residential Real Estate Rule that went into effect on March 1, 2026.
While the future remains uncertain, businesses and individuals purchasing residential property without financing through a legal entity or trust should remain prepared to provide information that may be required for FinCEN reporting if the Residential Real Estate Rule is reinstated.

A significant legal development has impacted the Financial Crimes Enforcement Network (FinCEN) Residential Real Estate Rule, which went into effect on March 1, 2026. Yesterday, a judge in the Eastern District of Texas issued a ruling vacating the FinCEN Residential Real Estate Rule in its entirety.

🚨Big Changes in Real Estate Closings! 🚨
As of March 1, 2026, the new FinCEN rule changed how we handle cash residential deals. If your buyer is an LLC, corporation, or trust, we now have federal reporting obligations.
✅ No price minimum – small deals included in reporting.
✅ Includes financed transactions when the lender is not AML compliant.
