🛡️ TITLE POLICY SERIES: ALTA OWNER’S POLICY
Yesterday, we explained that a Lender’s Loan Policy protects the lender. Today, let’s talk about the policy designed to help protect the homebuyer.
An ALTA Owner’s Policy provides protection against covered title problems generally connected to events that occurred before closing—even if the issue is discovered afterward.
âś… What it may protect against:
• Someone else claiming ownership
• Undisclosed liens or assessments
• Forged or improperly signed documents
• Certain fraud or impersonation in the title history
• Recording errors
• Lack of legal access
• Unmarketable title
• Legal defense expenses for a covered claim
🏡 Why it matters:
A title search helps uncover problems before closing, but some hidden issues may not appear in the public records. An Owner’s Policy provides an additional layer of protection for your ownership rights and home equity.
⚠️ What buyers should understand:
An Owner’s Policy does not cover every possible property issue. Coverage is subject to the policy’s terms, exclusions, exceptions and underwriting requirements.
Unlike the lender’s policy, an Owner’s Policy protects the buyer and is purchased with a one-time premium at closing. Coverage generally continues for as long as the insured retains an interest in the property, subject to the policy terms.
The simple takeaway: Your lender protects its loan. An Owner’s Policy helps protect what belongs to you.
