Well, it is finally here.
This week, our attorneys will be filing a lawsuit in Missouri Circuit Court against Sun West Properties Missouri LLC and the other individuals and entities whose conduct contributed to the serious problems surrounding the purchase, renovation, sale, and condition of our home.
The lawsuit will seek accountability for the defective and undisclosed conditions, the representations made about the property, the work performed before the sale, and the substantial financial losses and disruption that followed. What was presented as a fully renovated home instead became a prolonged and costly fight involving failed plumbing, electrical concerns, water intrusion, HVAC issues, contamination, code and permit questions, and other conditions that should not have been left for the buyers to discover and repair after closing.
This filing represents the culmination of extensive documentation, inspections, estimates, photographs, communications, professional evaluations, and repeated efforts to resolve these issues without litigation. Those efforts did not produce a fair or complete resolution.
We are now asking the court to examine the evidence and hold Sun West Properties Missouri LLC, along with every responsible party, accountable for their respective role in what occurred. This is not simply about one defective repair or one disagreement after closing. It is about the full course of conduct, the condition in which the property was sold, the representations that were made, and the damages that followed.
The lawsuit is only the beginning of the formal process, but after more than two years of gathering evidence and pushing for answers, the matter is finally moving into court.
