Every spring, I have the same conversation with homeowners across Katy and Fulshear, and I want to have it with you before it's too late to act on it. People assume summer is the magic moment to sell. June. July. August. Sunshine, school's out, families are moving. It *sounds* right. But after years of watching this market up close, I can tell you that waiting for summer is one of the most common - and costly - mistakes a seller can make.

Here's what the numbers actually show.

Look at our local market over the past five years. Closing activity peaks hard in May and June, then falls off a cliff. Every single year. Like clockwork. Every month, around the first, I grab a cold drink and open the MLS. And every month I think, “Alright… what did Katy and Fulshear do this time?”

Did prices creep up again?

But here’s what I always tell people. The overall Katy and Fulshear stats are helpful. They set the tone. But they don’t tell you what is happening on your street.

Firethorne is not Tamarron. Cross Creek Ranch is not Cinco Ranch. Some neighborhoods are moving fast. Others are giving buyers a little breathing room. That is why at the bottom of the report I link to detailed breakdowns for the most popular communities in our area. If you live here, that is where the real story is.

If you’re a Texas residential landlord and you’ve heard that the rules changed this year, you’re right. As of January 1, HB 38 is in effect, and it tightens up eviction timelines. Translation. Courts are moving these cases faster.

Here’s the real world flow. 👇

📝 Step 1: Deliver a written Notice to Vacate. Typically, 3 days unless your lease says otherwise. That starts the clock. Electronic delivery was added to your options this year.

⚖️ Step 2: File in JP court. If your tenants don't move out,
you file in the Justice Court where the property is located, pay the fees, and a constable will deliver notice of hearing.

📅 Step 3: Hearing gets set. The court must set it 10 to 21 days after filing. Show up with your lease, notice, and payment ledger.

⏳ Step 4: 5 day appeal window. If you win, the tenant has 5 days to appeal. Your tenant must pay back due rent to appeal now. No appeal, you move forward.

🚪 Step 5: Writ of Possession. If they still haven't moved out, you request a writ of possession. The constable posts a 24 hour notice. Then possession is returned to you.

In a clean case with no appeal, you’re usually looking at about 3 to 5 weeks from notice to getting your property back. It is not instant. But it is structured. And now, under HB 38, it is tighter on timing.
