Under Fair Housing guidelines, an assistance animal is not considered a pet.

That means a person with a disability may request a reasonable accommodation to keep an assistance animal, even in housing with a “No Pets” policy.

Many people are surprised to learn:

✅ Assistance animals can include service animals and emotional support animals
✅They help alleviate effects of a disability
✅They do not automatically require specialized training
✅ A certificate alone is not what determines whether an animal qualifies

For landlords, property managers, Realtors, and tenants, understanding housing laws is important to help avoid Fair Housing violations.

As a real estate agent, contacting an attorney on behalf of your client and then relaying legal advice back to your client can still be considered the Unauthorized Practice of Law (UPL).

Your role is to help facilitate the transaction — not interpret legal advice, contracts, or act as the middleman for legal opinions.

✅ Best practice: Encourage your client to speak directly with the attorney so they receive the information firsthand.

Protect your license. Protect your client. Protect the transaction.

💧 Did You Know? (Bell County Edition)

If you own land in Bell County… your groundwater isn’t just “yours” to use however you want 👇

Across Texas—including here locally—Groundwater Conservation Districts (GCDs) play a big role in how water is managed.

According to the Texas Real Estate Commission and Texas water governance:

👉 There are 98 GCDs across Texas
👉 They regulate groundwater usage within their boundaries

And yes… this impacts Bell County properties 👇

GCDs can:
✔️ Enforce well-spacing requirements
✔️ Require permits or registrations for wells
✔️ Monitor groundwater levels
✔️ Impose restrictions during droughts (which we see often in Texas)

Real talk:
Buying land with “water access” doesn’t mean unlimited use.
There are rules—and if you don’t know them, it can affect your plans fast.

Bottom line:
Before you drill a well or rely on groundwater… make sure you understand the local district rules. That’s how you protect your investment and avoid surprises.

Water rights in Texas aren’t all the same—and this one surprises a lot of people 👇

Surface water (think rivers, lakes, streams) is NOT owned by the landowner…

👉 It is owned by the State of Texas and held in trust for the public

According to Texas law and principles recognized by the Texas Real Estate Commission:

👉 The state controls surface water
👉 Individuals and entities must obtain permission (water rights) to use it

Who gets access? 👇

Farmers & ranchers 🌾
Cities & municipalities 🏙️
Businesses & industries 🏢
Other public and private users

Real talk:
Just because your property touches a river or lake… doesn’t mean you can freely use that water.

You may have access—but not automatic rights to use it.

Bottom line:

Groundwater = typically belongs to the landowner (with limits)
Surface water = belongs to the state

Know the difference… because it can impact land value, use, and future plans.

Groundwater in Texas has a long-standing rule—and it still matters today 👇

Historically, groundwater has been considered the property of the landowner… and in most areas of Texas, that’s still generally true.

According to the Texas Real Estate Commission framework and Texas property principles:

👉 If you own the land, you typically have rights to the groundwater beneath it
👉 This is often referred to as the “rule of capture”

But here’s the part people miss 👇

Real talk:
Those rights aren’t unlimited. In many areas, local groundwater conservation districts regulate:

How much you can pump
Well permits
Usage restrictions

So just because you “own” the groundwater… doesn’t mean you can use it however you want.

Bottom line:
Groundwater rights can be valuable—but they’re also regulated. Know the rules before you rely on them in a deal.
