Attorney General Ken Paxton Secures Major Win; Texas Election Integrity Law Banning Vote Harvesting Schemes Will Remain in Effect for November Elections



AUSTIN – Texas Attorney General Ken Paxton secured a stay from the U.S. Court of Appeals for the Fifth Circuit, enabling a key provision of Senate Bill 1, a Texas election integrity law, to remain in effect for the November 5, 2024, elections.



SB 1 increased safeguards to prevent ballot harvesting and instituted additional protections to strengthen election integrity. However, shortly before early voting was scheduled to start in Texas, a federal district court ruled that such provisions violate the First and Fourteenth Amendments. The judge also banned the Office of the Attorney General from opening investigations into potential violations.



Attorney General Paxton immediately appealed the ruling and obtained a temporary stay from the Fifth Circuit on October 4. He has now secured a full stay pending appeal from the Fifth Circuit, blocking the district judge’s injunction and permitting the Office of the Attorney General to conduct investigations into illegal vote harvesting.



The Fifth Circuit explained: “On the eve of elections in Texas, the district court has entered an injunction that impacts how ballots can be handled. It holds unconstitutional a law that has been on the books for over three years, but that the court did not see fit to enjoin until now. The Supreme Court has instructed lower courts not to unduly delay ordering changes to election law until the eve of an election.… We accordingly grant the State’s request for a stay of the injunction pending appeal.”



“We fought hard to ensure that the Texas laws protecting the ballot box will be in full force and effect this election season,” said Attorney General Paxton. “I will continue to do everything in my power to protect the integrity of our political process.”

One of the major issues we have is that we seem to have several decades of those who either weren't taught how to think for themselves or don't wish to do so.

We the People should be constantly questioning our govt. ... no matter who is in office ... and a large majority demanding answers.

So many things happen but I hear insufficient Voices demanding answers. Washington hasn't heard from US since the 60s and 70s and the result is they don't feel they are required to be answerable and so they basically do as they please.

One of those issues is voter ID. This admin tried to pass a bill early on that would transfer all of our voter info. to Washington who would then control voters records. So far; after multiple attempts this has failed.

The following report is also interesting. Why? Why has there been no effort to comply? Our voter rolls should be a Fed. govt. priorities ...

Attorney General Ken Paxton Requests Voter Registration Data from Secretary of State to Force Federal Government to Verify if Noncitizens Are Illegally Registered



AUSTIN – Texas Attorney General Ken Paxton sent a letter to Texas Secretary of State Jane Nelson formally requesting the records of every registered voter without a State of Texas-issued driver’s license or identification card number in order to facilitate efforts to stop noncitizen voting and investigate potential voter fraud.



On September 18, Attorney General Paxton urged Secretary Nelson to request data from the federal government that would enable Texas to determine the citizenship status of certain registered voters for whom the state cannot verify eligibility to vote. The Secretary of State’s Office ultimately sent a request to the federal government that allows for excessive delays, potentially preventing Texas from receiving this critical information before the election. Crucially, the request sent by SOS did not provide any information to the federal government about the individuals whose citizenship status needs to be verified, which defeats the purpose of the letter.



Now, two weeks later and just one month from the election, the Texas Secretary of State still has not sent the list of Texas’s potential noncitizen voters to the federal government for verification. Today, Attorney General Paxton has requested the Secretary of State voluntarily share the list of potential noncitizen voters with the OAG through intergovernmental information sharing and has made a Public Information Act request to the Secretary of State’s office for the registration data to alternatively send it himself.



The letter to the Secretary of State reads: “As our offices continue our cooperative efforts on the critical issue of election integrity, my office has identified information maintained by the Secretary of State that will facilitate our efforts to prevent non-U.S. Citizens from casting illegal votes in Texas elections and to investigate potential voter fraud. To that end, I formally request that you provide to my office each record in the statewide voter registration database (TEAM) for which the Secretary of State does not have a State of Texas issued driver’s license or identification card number for that individual.”



“There is no time for delay. Texans cannot afford to lose another second waiting for their vote and their voice to be protected from illegal ballots,” said Attorney General Paxton. “Every election official in the State must join me in prioritizing this. Our State and our Country are counting on you to do everything possible to expedite transparency and accountability to secure our elections and make sure noncitizens do not illegally vote.”

Attorney General Ken Paxton Sues Big Pharma Drug Manufacturers and Pharmacy Benefit Managers for Conspiracy That Increased Insulin Prices by 1,000%



AUSTIN – Texas Attorney General Ken Paxton sued major insulin manufacturers and pharmacy benefit managers (“PBMs”)—including Eli Lilly, Express Scripts, CVS Pharmacy, and others—over a conspiracy to increase prices of insulin.



Through this conspiracy, the manufacturers artificially and willingly raised the prices of insulin then paid a significant, undisclosed portion back to the PBMs as a quid pro quo for inclusion in the PBMs’ standard offerings. The PBMs then granted preferred status to the manufacturer whose drug has the highest list price while excluding lower priced drugs. These synthetic insulin drugs, which today cost the manufacturers less than $2 to produce and were originally priced at $20 when released in the late 1990s, now range between $300 and $700. In the last decade alone, the manufacturers who are defendants in the lawsuit have increased the prices of their insulins up to 1,000%. Attorney General Paxton is suing because the insulin pricing scheme violates the Texas Deceptive Trade Practices Act, constitutes unjust enrichment, and represents an unlawful civil conspiracy.



“This is a disturbing conspiracy by which pharmaceutical companies were intentionally and artificially inflating the price of insulin. Big Pharma insulin manufacturers and PBMs worked together to take advantage of diabetes patients and drive prices as high as they could,” said Attorney General Paxton. “These companies acted illegally and unethically to enrich themselves, and we will hold them accountable.”



According to the complaint, “While the PBM Defendants represent that they perform their services on behalf of their clients (including Texas payors) and diabetics to lower drug prices, increase access to affordable drugs, and promote diabetic health, these representations are false. Rather, the PBM Defendants have worked in coordination with the Manufacturer Defendants to distort the market for diabetic treatments to their benefit at the expense of Texas diabetics and payors.”

Texas Secretary of State Releases Election Audit Reports
AUSTIN — Secretary of State Jane Nelson today released election audits for the 2021-22 election cycle conducted in four selected counties.
“Texas’ audit process provides accountability and insight into how elections are conducted on a county level to ensure the integrity of our elections,” said Secretary Nelson. “While each audit is specific to a county, they include lessons for election officials across the state and offer voters the reassurance that our state’s election processes are thoroughly reviewed.” In 2021, Governor Greg Abbott signed Senate Bill 1 into law, which included a provision requiring the Office of the Secretary of State to conduct audits in four randomly selected counties.
The four counties evaluated for the 2021-2022 election period are:
Harris key findings:
In defiance of state law, Harris County failed to estimate and issue the required amount of ballot paper resulting in interruptions in voting in at least 19 polling locations in the November 2022 Election.
Harris County failed to properly train its election workers to operate new voting equipment, resulting in widespread voting equipment failures in multiple elections.
Harris County did not follow state law establishing proper voter roll maintenance activities. Harris County failed to keep an accurate list of registered voters in their county records, which has since been addressed and corrected.
In numerous elections, required paperwork from polling locations was incomplete and failed to meet the requirements outlined in law.
Although Harris County has since made changes to its election administration, the findings highlighted in this audit and the prior audit show that an enhanced presence by the Secretary’s office is necessary for the November 2024 election. The Secretary of State will assign state inspectors to Harris County to perform checks on election records, including tapes and chain-of-custody, and will observe the handling and counting of ballots and electronic media during the November 2024 election period. Additionally, staff from the Secretary’s Elections Division will be present to assist Harris County for the duration of the election period from early voting, to Election Day, and through tabulation.

Buyers in swing states have seen mortgage payments practically double in the last four years due to rising home prices and mortgage rates.

Attorney General Ken Paxton Sues Harris County Over Illegal “Guaranteed Income” Welfare Scheme



AUSTIN – Texas Attorney General Ken Paxton has sued Harris County for instituting an unlawful “guaranteed income” program that redistributes public money in a manner that violates the Texas Constitution.



Announced by Harris County Judge Lina Hidalgo in 2023, the program would randomly select 1,928 eligible Harris County residents by lottery to receive $500 cash payments for 18 months with “no strings attached.” The money itself comes from the $20.5 million the county received through the 2021 American Rescue Plan Act which was specifically intended to be used for COVID-19 relief initiatives. The program was met with additional backlash when it was announced that certain classifications of noncitizens would be eligible for the handouts.



The Texas Constitution expressly forbids “any county, city, town or other political corporation or subdivision of the State … to grant public money or thing of value in aid of, or to any individual.” Harris County’s program to give public money away with no conditions, no control over expenditure of that money, and no guarantee of public benefit is prohibited. The Constitution also provides that everyone has “equal rights, and no man, or set of men, is entitled to exclusive separate public emoluments.” This lottery-based handout violates the Texas Constitution because the selection of recipients is inherently arbitrary. County governments have limited authority to act and, like all governments, can only act in accordance with the Constitution. Harris County has exceeded that authority.



“This scheme is plainly unconstitutional,” said Attorney General Paxton. “Taxpayer money must be spent lawfully and used to advance the public interest, not merely redistributed with no accountability or reasonable expectation of a general benefit. I am suing to stop officials in Harris County from abusing public funds for political gain.”

OK guys ... I need to touch base with everyone in the area of Splendora, Cleveland, Dayton, Huffman, Crosby .. in general areas.

There is a large mama dog who looks to be (part) Great Pyrenees who has blessed the area with 10 truly beautiful babies and those of us trying to help out are trying to find a rescue group who can help with the puppies in about 2 weeks. They should be about 6 weeks old then. Help will be arranged for delivery, food, etc. to help out.

We need help because we know that just collecting them up and trying to give them away is no protection against some of the cruelest people on the planet.

If you know of those who are qualified as rescues who could help; please message me and I will put them in touch with the individuals directly involved in taking care of these babies.

They are fat, appear healthy, roly poly and totally adorable. A home for mama has been found when time comes.

I suspect that most on this page are probably pretty well informed as to how to vote but ... maybe you know someone you could pass this on to? Encourage them to go vote? A big part of this Nation's problem is uninformed citizenry and those who never had it impressed on them just how ... really, really ... important their vote is ... so important that many have given their lives to protect this Right .. and Privilege.

Primary Election Day Reminders from Secretary Jane Nelson

What Texans Need to Know Before Heading to the Polls

AUSTIN—Texas Secretary of State Jane Nelson shared important reminders for Primary Election Day on March 5.

“Primary elections are an opportunity for Texans to weigh in on who will be the candidates for the Republican and Democratic parties on the ballot in November,” said Secretary Nelson. “Texans who wish to participate in the primary elections will need to indicate which primary in which they want to vote.”

Ahead of the Primary Election, Secretary Nelson conducted a voter education tour, working alongside county officials and election leaders across Texas to ensure every qualified voter has the information needed to cast a ballot.

Election Day voting hours are 7:00 a.m. to 7:00 p.m. at all polling places statewide. Texans can find their polling place by using the My Voter Portal. If a county participates in the Countywide Polling Place Program, voters may cast a ballot at any location in their county on Election Day. If a county does not offer countywide polling, voters must cast their ballot at a location specific to their registration precinct.

Questions regarding polling places can be directed to each county elections office.

At the polls, voters should come prepared to present one of the seven acceptable forms of photo ID:

Texas Driver License
Texas Personal Identification Card
Passport
Texas Handgun License
Military Identification Card
Citizenship Certificate
Texas Election Identification Certificate
It is important to note a student ID is not one of the approved forms of photo ID.

Voters who do not have and cannot reasonably obtain one of the seven approved forms of photo ID can fill out a Reasonable Impediment Declaration at the polls and present an alternative form of identification, such as a utility bill, bank statement, government check, or a voter registration certificate.

Under Texas law, the use of items like cell phones, tablets, cameras, or any form of wireless communication or recording device is not permitted within 100 feet of voting stations.

Many are unaware that there is no shortage of plans and schemes to tie up/own/control our real estate inventory. The goal is to prevent personal wealth through our ownership which is one of the most wonderful opportunities this country has to offer. Many homes are being bought up and/or repoed that are being turned into expensive rentals taking them off the market long term. We are already seeing shortages in some areas but this morning I came across this little tidbit. Potentially millions of homes could be no longer available for decades because if they don't have to make payments; why would they ever move? What will our grown children and grandchildren have left to acquire.

This has probably happened before but I've just never seen it. Wow .. we seem to be living in a country where .. more and more every day ... so many just don't care and are determined to do as they please. No rules apply to them ... we're sittin' on a powder keg.

Attorney General Ken Paxton Secures Injunction Against Castleberry ISD for Illegal Electioneering

AUSTIN – Texas Attorney General Ken Paxton has secured an agreed injunction with Castleberry Independent School District (“ISD”) after suing the district for illegal electioneering.



Earlier today, Attorney General Paxton sued Castleberry ISD after its superintendent used state resources to distribute a list of political endorsements and instruct the district’s administration to “vote accordingly.” Doing so was in clear violation of the Texas Election Code’s prohibition against the use of “resources of the district to electioneer for or against any candidate, measure, or political party.” After being sued, Castleberry ISD agreed that the superintendent and all employees would not use any funds or resources, including emails, to engage in illegal electioneering.



Despite being currently prevented from prosecuting criminal violations of the Election Code due to the Court of Criminal Appeals’ decision in Texas v. Stephens, Attorney General Paxton sought civil injunctive relief and has now obtained an agreed injunction against Castleberry ISD to end its unlawful attempts to influence elections. School districts should be aware that illegal electioneering is criminal conduct and violators could be subject to criminal prosecution by local authorities. While unable to criminally prosecute violators at this time, Attorney General Paxton is committed to using all available means to protect the integrity of Texas elections.



This case is part of an ongoing effort by Attorney General Paxton to ensure that Texas elections are not illegally influenced by public officials improperly using state resources. In addition to Castleberry ISD, Attorney General Paxton also sued Denton ISD, Denison ISD, and Frisco ISD for illegal electioneering. The Office of the Attorney General is currently investigating other possible violations across the state.

Ken Paxton is the 51st Attorney General of Texas. He was elected on November 4, 2014, and sworn into office on January 5, 2015. He was re-elected to a second term in 2018 and a third term in 2022.

Here's a little email update I got from Dan Crenshaw .. the local Rep for many of us in this area. I'm glad to see that necessary work will be done to the Bear Branch Dam in the Woodlands ... and next ... this area needs massive amounts of work done because of the issues with the San Jac ... work that has need to be done for .. decades and across multiple counties. For those who wish; you can sign up for this email from Dan and you can also attempt to reach him there but ... he's never responded to any of my questions. I have been invited to his town halls and other doings though but I've never yet been able to attend.
