I finally got through the entire 9/22 planning commission meeting. IT WAS ROUGH!!!

I think I have this correct for Resolution 26-110 and 26-111

Approved by the Planning Commission:

Existing Variances:
Kuau Plaza
Hale Kaanapali (Maui Kaanapali Villas)

Timeshare:
Maui Schooner
HonoKoa

Not Sure Why but Approved:
Hana Kai

All other properties on 26-110 and 26-111 were denied by the planning commission. I was not familiar enough with the commission members to report on their individual statements. However, there only seemed to be one reasonable person on the commission who understood the true impact of Bill 9 and also understood the potential danger these properties would be to long term use owners and renters. Unfortunately, that member was out-voted by people who myopically saw every unit as a "housing unit" regardless of the realistic affordability and size/amenities of the units.

One commission member stated and voted specifically to force a majority vote by the council to override the commission's recommendation. Personally, it seemed like a bit of collusion with council members to me. I have no proof, but I think it will have the same result as if it was.

Sad day for Maui, but not unexpected.

UPDATED 9/25/26 at 329pm HST
I updated the chart and included the Planning Commission approvals/denials. The yellow properties are from Resolution 26-110. Orange = 26-111. Blue = 26-129. Green = 26-130.

So far 85 properties have been addressed by a Rezoning Resolution with 22 properties remaining. I expect most of the remaining 22 properties to be included on a future resolution.

Here is the updated list of rezoning resolutions and included properties. I will update the list next week if there are any changes after today's meeting at 9am HST. Today's County Council meeting is to discuss and potentially vote on resolution 26-129. A "Yes" vote will forward the 26-129 properties to the planning commissions for review.

Quick heads up for my Maui friends — this Friday, September 25th at 9:00 AM, the Maui County Council will be voting on whether to send a proposed resolution (26-129, CD1) over to the Maui Planning Commission for further review.

The resolution deals with community plan amendments and zoning changes affecting a number of condo properties listed below in South and West Maui. We're expecting future resolutions to include more Minatoya condos affected by Bill 9.

This is just the referral step — not a final decision — but worth keeping an eye on if you own or are watching real estate in these areas.

More Money For Housing Vouchers Has Not Helped Enough Renters, Study Says

Hawaiʻi Construction Industry Pushes Constitutional Amendment to Lower Housing Costs

Constitutional amendment question 2 is mostly about paying for new roads, bridges and water systems, which until now housing developers had to pay for themselves upfront. The tax-free bonds, already used across the country, are paid back from future property taxes generated by new homes and businesses in an improvement district.

Hawaii developers are campaigning for a constitutional amendment to fund infrastructure and lower home costs, but worry voters may be confused.
