A new pro-Amendment 5 ad tells a DRAMATIC STORY about data centers, “big tech,” and a “1917 tax code” that supposedly lets them “get away tax free.”

NEWS FLASH: 1917 has NOTHING to do with data centers.

1917 is when Missouri adopted the state income tax.

The data center tax breaks the ad is talking about were created in 2015, when the Missouri Legislature passed Senate Bill 149.

That law created state and local sales and use tax exemptions for qualifying data center projects, including computer equipment, construction materials, and utilities.

And here’s the key point: AMENDMENT 5 does NOT eliminate those data center tax breaks.

If lawmakers want to end or change those breaks, they can do that directly through state law. That would take separate legislation.

The villain in the ad—the humming server farm getting rich off p**n and gambling—is NOT stripped of its tax break by Amendment 5, NO MATTER HOW THE VOTE TURNS OUT in August.

It’s also worth asking who is paying for the ad. Missouri Promise PAC received $1.9 million from Missouri Promise Inc., a nonprofit incorporated in Delaware whose original donors are not publicly disclosed.

What would Amendment 5 actually do? It would:

⬇️ Phase out Missouri’s income tax
🛒 Expand sales tax authority
📜 Change constitutional tax protections
💸 Shift taxes to everyday purchases and services
❌ NOT repeal the data center tax exemptions

So don’t let one ad make this sound like a simple “big tech loophole” fix.

The real question is whether Missouri should change its Constitution to eliminate income tax and expand sales tax.

🚨 Amendment 4 is on the August 4 primary ballot.

For more than 100 years, Missourians have had the power to use the citizen initiative process to put constitutional amendments before voters.

Amendment 4 would change that process by requiring citizen-led constitutional amendments to pass by:

✅ A statewide majority
✅ A majority in all 8 congressional districts

That means one district could block an amendment supported by voters statewide.

And here’s the fairness concern:
This tougher standard would apply to citizen-led amendments.....but not to amendments placed on the ballot by the legislature.

Legislature-led amendments could still pass with a simple statewide majority.

The Missouri Independent reported that under this kind of requirement, as few as 5% of voters could block what a statewide majority supports.

Know what’s on your ballot before you vote August 4.

One thing that doesn't get enough attention with Amendment 5 is how geography could affect state revenue.

We all know where Missouri's largest cities are, and it's not hard to imagine many people in those areas simply crossing state lines to make their purchases. Those of us in rural and central Missouri won't have that same option, either because of time, distance, or cost.

And if the state comes up short on revenue, the legislature would have complete authority to raise taxes or expand the tax base to make up the difference.

Basically, Amendment 5 asks rural and central Missouri to carry more of the load while giving politicians in Jeff City, with no doubt some input from their donors, control over who, what, and how much is taxed.

Vote NO on Amendment 5.
