š« Donāt Be That Guy
In real estate, a will alone does not transfer ownership of real property.
Probate exists for a reason ā to protect heirs, buyers, and the integrity of the title.
Years ago, a man came into our office absolutely furious. He had been told that his loved oneās will was not enough to sell the home, and he was convinced everyone else was wrong.
He insisted he knew more than the attorneys.
He demanded we ājust move forwardā and close the deal anyway.
So I did what years ā decades ā of probate and title experience have taught me to do. I calmly explained the reality:
Without proper court authority, no deed can be recorded.
No buyer is protected.
And no title company can insure the transaction.
I laid out the exact steps required ā including being formally appointed Personal Representative ā before anything could proceed.
He didnāt like that answer.
He stood up from the closing table, grabbed my candy dish, threw it across the room at me, and told me heād never work with me again.
Fast forward a few monthsā¦
He was back at our closing table.
Court orders in hand.
Signing documents the right way ā because he had finally been appointed Personal Representative.
Hereās the truth:
You canāt bully your way around the law.
You canāt threaten your way past probate.
And you canāt force a title company to record an invalid deed.
But you can do it the right way ā and get it done.
