How does this Federal shutdown affect real estate? Thank you John Lamberg for the following information:

While the Government is shut down, there are a few important items to understand regarding the impact on the Real Estate/Mortgage Industry:

At this time, USDA employees have been furloughed and loan fundings have been suspended. USDA loans cannot close until funding has been restored and all employees have returned to work.

The NFIP (National Flood Insurance Program) will not be available during the shutdown. Private flood insurance is NOT impacted so there are still options available for those in need of a flood policy.

Tax transcripts are not processed during the shutdown. In most cases, transcripts are pulled on every loan. The Mortgage Firm is making an exception to this rule in most cases and we can get by without them. Borrowers should be prepared to show evidence that returns were filed and outstanding taxes have been paid or a payment agreement is in place. Iโ€™m looking into if this will impact Florida Housing programs that utilize down payment assistance programs.

Borrowers on mandatory furlough from their jobs must return from work prior to closing in order to use their income for qualifying purposes. For VA loans, a copy of their furlough will be required for verification purposes upon return to work. For FHA loans, for federal, state, tribal or local government employees temporarily out of work, income preceding the shutdown can be considered as effective income.

Social Security Verification- When data integrity issues pertaining to a borrowerโ€™s SS number are identified and we cannot validate directly with Social Security Administration the loan will not be eligible for closing until direct validation is available.

President Donald Trump recently signed the Homebuyers Privacy Protection Act of 2025 into law. This bill is a significant victory for the real estate industry, as it directly addresses the problem of unwanted calls, texts, and emails that often flood clients upon mortgage application.

What's Changing?

For years, many borrowers have experienced a barrage of unsolicited contact from different lenders immediately after their mortgage application. This happens because of "trigger leads"โ€”a process where credit reporting agencies sell information to other companies once a credit inquiry is made.

Effective March 5, 2026, this new law will put a stop to this practice. It will severely limit who can receive client contact information, ensuring client privacy is protected. A credit reporting agency will only be able to share trigger lead information with a third party if:

Clients explicitly consent to the solicitations.
The third party has existing business relationship.
This change means a more efficient, respectful, and responsible homebuying journey.

In the meantime, you can use the below information to inform clients how to proactively protect themselves from unwanted solicitations.

OptOutPrescreen.com: You can opt out of trigger leads through the official opt-out service, OptOutPrescreen.com.
Do Not Call Registry: You can also register your phone number with the National Do Not Call Registry to reduce unsolicited calls.
DMA.choice.org: For mail solicitations, you can register with DMA.choice.org to reduce promotional mail.
