Regarding the NEW NMAR purchase agreement:

Did you know title companies are not to open escrow until Independent Consideration (“IC”) is received by either the seller or the title company?

This is not title company policy. It is written into the terms of the purchase agreement.

Equally important, if Independent Consideration is not delivered by the timeline identified, the purchase agreement immediately terminates without remedy!

While the Treasury Department’s Financial Crimes Enforcement Network’s major real estate transaction reporting rule is on pause following a court vacatur order, the American Land Title Association is taking the opportunity to push for reform.
