Georgia State of Emergency Update

On October 8, 2026, Governor Kemp issued a new State of Emergency declaration in response to Hurricane Isaias.

🏡 What does this mean for your real estate transaction?

This new declaration is separate from the previously issued State of Emergency and may provide additional time for certain unexpired deadlines under the GAR Purchase and Sale Agreement (excluding the New Construction Purchase and Sale Agreement).

Governor Kemp declared a 30-day state of emergency in GA that begins today at noon. If you have an existing contract on GAR forms, then all unexpired deadlines automatically extend for 8 days. If you don’t want deadlines to extend, then the parties will need to sign an amendment stating something like the following: “No deadline under this Agreement shall be extended solely by reason of the 30-day state of emergency declared by Governor Brian Kemp beginning September 29, 2026.
