My Board of Equalization meeting went well this morning. The board members asked good questions. The staff assessor reduced my property values $435K. Now to see how the board rules on my argument that we have no supreme law of the land and have been reduced to the law of the survival of the fittest by the state's refusal to do what the constitution demands. In the mean time, without the state doing 2 things, we all are placed in a legal impossibility and do not have the ability to pay our taxes: 1- declare which gold and silver coin will be used for that purpose; and 2- see to it that enough of it is in current circulation that we, the people, can work and acquire it (without going through a "money changer") so we can pay our tax debt. I'll try to post the hearing video when it comes available.

County land use planning. What is it's authority to plan? To start, a county is a corporation and can only do what the law creating it allows it to do, and that within constitutional restraints. So, the law creating counties in Washington state:

RCW 36.01.010 - Corporate powers.
The several counties in this state shall have capacity as bodies corporate, to sue and be sued in the manner prescribed by law; to purchase and hold lands; to make such contracts, and to purchase and hold such personal property, as may be necessary to their corporate or administrative powers, and to do all other necessary acts in relation to all the property of the county.

Notice way down at the end "all the property of the county"? That does not include all property "in" the county. Property "of" the county belongs to the corporation. County planning jurisdiction only extends to property (real or personal) that BELONGS "TO" the county. This may be useful for those who want to buy or start a single family residential Vacation Rental in Chelan County that is not a Chapter 70.62 RCW transient accommodation.

Chelan county has a moratorium on vacation rental homes and is formulating a code to regulate them with licenses that will be decided August 25. No one knows what the final code will be, but a violation of it will not be criminal. So, if you don't get the license (and not be liable for the lodging tax) the only way an inspector or code enforcer could come on your property would be with a search warrant showing probable cause of a crime. If you apply for the license, even though it is not granted, it is considered your permission to enter to inspect. Things to consider as you navigate your way through the vacation rental investment operation.
