My name is Tatum Feiler, I am a KY realtor, who’s been practicing for 5+ years throughout several areas! All my ky friends who are looking to purchase a home in the future, there have been some policy changes that went into effect August 13. Major highlights are that documentation has to be signed BEFORE showing any homes to buyer, that can be an Exclusive Buyer Agency Agreement (Long term agreement) or One-Time Buyer Agency Agreement (short term, applies to one specific house you’re interested in). The second major highlight is how commissions for Buyers Agents present and are delegated, this is now a point of negotiation just like closing time frame, sales price, etc. On the agency forms, the commission will be established. However, if the commission established by buyer agent/buyer is more than what seller is willing to pay, the buyer will now become responsible for covering the difference. The difference could be rolled into loan depending on eligibility. Even if you’ve already been looking at houses with one or more agents without signing anything, you will now have to sign one of the two forms before seeing any other homes, or buyer agent can be hit with hefty fines. These changes have happened due to an NAR (National Association of Realtors) lawsuit and settlement. While this definitely adds new elements and changes, I do believe if you pick a realtor who wants the best for you that these changes shouldn’t deter anyone interested in establishing a permanent residence. It’s completely understandable to overthink your eligibility, current market, or rates especially as a first time buyer! My best advice: Give yourself the credit you deserve! Talk with a lender, ask questions, and think about why this is or isn’t a good time for you to purchase a home, outside of rates or current market.
