First look at bill introductions:
LB740 (McKinney)
- requires DHHS to seek a waiver to use Medicaid for Housing First services and permanent supportive housing.
- covered services include housing transition services, outreach, application assistance, landlord engagement, tenancy sustaining services like case management and eviction prevention, housing navigation and stabilization services, care coordination
LB809 (Dover)
- prohibits municipalities from enacting any ordinance that prohibits source of income discrimination
LB880 (Guereca)
- prohibits landlords from stopping a tenant from making payments by "mean of an automated clearinghouse transfer" or charging them extra for that type of payment
LB925 (Andersen)
- This is probably the very worst version of a ban on homeless encampments that we have seen so far.
- Prohibits "camping" in any parks or public rights of way.
- "Camping" is defined as "to sleep upon, occupy, or otherwise use an area as a substitute for regular shelter, as evidenced by, but not limited to, the er****on of a tent or other temporary shelter, the presence of bedding or pillows, or the storage of personal property"
- provides a Class V misdemeanor for violation (or, on the first instance, law enforcement will bring them to the nearest shelter)
- allows any "aggrieved" person to file a civil action against the political subdivision for failure to enforce the ban AND
- if the political subdivision is found to be in violation of this law, the state will withhold all state and federal funds meant to address housing or homelessness
