IN THE SUPREME COURT OF THE STATE OF KANSAS Administrative Order 2023-CC-074 Unavailability of Electronic Filing Systems Continues.
On October 12, 2023, this court issued 2023-CC-073 regarding the unavailability of electronic filing systems. Again today, this order provides that the appellate court clerk's office and all district court clerk's offices except Johnson County are inaccessible because the electronic filing systems in those courts are unavailable. Under Supreme Court Rules 1.14 and 122, the provisions of K.S.A. 60-206, and amendments thereto, apply from Thursday, October 12, 2023, until further order of this court. A party whose filing is untimely due to the unavailability of the electronic filing systems may seek relief from the applicable court. During the pendency of this order:
• The system for making payments with a credit card, electronic check, or other electronic method are also unavailable.
• All parties will be allowed to file by facsimile unless the filing requires a payment.
• All parties will be allowed to file in person during the applicable clerk of the court's normal business hours.
• All parties will be allowed to file by mail.
• When service is required, parties are reminded that while the electronic filing systems are unavailable, electronic service is also unavailable.
• Due to the inaccessibility of the case management systems, parties should include any previously filed documents that may be needed to consider their current filing.
• When filing documents with the clerk of the appellate courts, file-stamped copies are not required. When the case management systems are again available, parties must supplement the case file with file-stamped copies.
