New Jersey Department of Environmental Protection Commissioner Ed Potosnak officially announced plans to extend legacy provisions in the Resilient Environmental and Landscapes rule by one year. The change in course from NJDEP will bring a REAL reprieve to engage with the folks the rules will impact, local governments, industry groups and the public.

NJDEP filed a rulemaking proposal on the extension that will publish in the New Jersey Register June 1. The change would move the legacy period for permit applications from July 20, 2026, to July 20, 2027.
