Realtors: We are almost halfway through with 2021 and it can become TAXING to wait to tackle organizing and sorting through all of your income and expense records if you put it off until the end of the year. As a former IRS agent and tax preparer/enrolled agent, I would like share some helpful tips to help you get organized and audit proof.

Relevant Tax Laws to keep in mind:
IRC section 162 - deduct only what is ordinary and necessary for your business

IRC section 274 - a)deductibility of entertainment expenses; limits to gift deductions; d) requirement for documentation for any and all travel, meals, and gift deductions

1099 Filing Requirements- payments to individuals (including non-corporate entities) that you paid over $600 for services in the course of your business

Common Realtor Deductions:
-Commissions Paid
-Referral fees
-Home Office (exclusively used space)
-Desk Fees
-Education & Training
-Marketing & Advertising Expense (from marketing materials to FaceBook ads, etc.)
-Mileage (must be well documented & detailed answering not only how many miles, but: When? What purpose?)
-Office Supplies & Equipment (equipment may need to be depreciated)
-Meals (document When? With who? What purpose?)
-Fees, Licenses, Memberships
-Self-Employed Insurance
-Software & Business tools
-Gifts deductions are limited to $25 per individual per year ( with some exceptions explained in IRC 274(b)(1)(A)

Recently, I received an email from ShowingTime to announce they had reached an agreement to be a part of Zillow Group. This seems to be another tactical move on the part of Zillow to remove the need for the Real Estate Agent.

But one reason, in my opinion, why Zillow, will not be able to replace or substitute the Real Estate Agent, is our ability to not only do the functional work, but the fiduciary work in a real estate transaction.

In “The Millionaire Real Estate Agent” by Gary Keller, he draws a “distinction between the two types of services being provided in the real estate industry: Functionary vs Fiduciary.

“...a fiduciary can easily do the functionary work, but a functionary CANNOT easily do fiduciary work.””

As real estate agents, whether new or seasoned, we should strive for excellence in our fiduciary services so that we are never replaced!
