Reminder: DuPage County Case 2022MR000752 will be heard on Thursday, July 2, 2026, at 9:00 a.m. in Courtroom 2005.

Case Update: MSVL has officially been joined as a party in the lawsuit involving Vertical Bridge and Bloomingdale Township.

Background: The Court determined that MSVL has a "present and substantial interest" in the disputed property. As Branigar's successor-in-interest, MSVL's ownership interest is central to resolving the dispute over the property, regardless of whether the area was dedicated as a public easement by statute or implication.

The Court further found that Bloomingdale Township's claim that the disputed area is held in public trust for future roadway purposes cannot be properly decided without MSVL participating in the case.

This follows the well-established legal principle of a necessary party, which requires that all parties whose property interests may be affected be included before the Court can issue a valid ruling. The Court also concluded that Vertical Bridge, as an easement holder, could not adequately represent MSVL's ownership interest. As a result, the previous judgment was determined to be void for lack of jurisdiction.

MSVL has officially joined the lawsuit with Vertical Bridge against Bloomingdale Township.

Background: "As the Court explained, MSVL possessed a “present and substantial interest” in the disputed property. Whether or not the strip had been statutorily or impliedly dedicated as a public easement, MSVL, as Branigar’s successor-in-interest, was central to resolving the ownership question. The Township's claim that it held the Disputed Area in public trust for future roadway purposes could not be litigated in MSVL’s absence.

This is classic “necessary party” doctrine. A court cannot adjudicate a property interest without all those potentially impacted present. Nor could Vertical Bridge, as an easement holder, adequately represent MSVL’s fee ownership. The judgment was therefore void for want of jurisdiction."

Community Opposition: Residents have strongly opposed the tower, noting 220 electors voted against it, and continue to urge the Medinah Spring Valley Lake (MSVL) board not to join legal actions supporting the tower.
Ongoing Delays: Recent, unofficial community updates indicated hearings were being continued due to ongoing administrative processes regarding the application

We need the Medinah Community to pay attention to the ongoing court battle to stop the proposed cell phone tower being built on MMedinah Spring Valley Lake, Inc.at the corner of Spring Valley and Glendale. Let our voices be heard! The electorates have voted against this! Let Medinah Spring Valley Lake's President and Board of Directors know that this is NOT COOL! The next Bloomingdale Township Meeting is Wednesday, May 20 at 6:30pm. Please join us for an update to Stop the Cell Tower on Medinah Spring Valley Lake. We were in court this past Friday, May 8, and Medinah Spring Valley Lake, Inc. (MSVL) is now a central party in the litigation surrounding the proposed cell tower. The appellate court found a previous judgment void because MSVL, as the record land owner, was not originally joined with Vertical Bridge in their lawsuit against Bloomingdale Township.
