DID YOU KNOW? — WHAT IS A LIEN?

You may have heard someone say, “There’s a lien on the property.” But what does that actually mean?

Simply put, a lien is a legal claim or interest against property, often connected to a debt or financial obligation. Depending on the type of lien and the circumstances, it may need to be addressed before a property can be sold or transferred with clear title.

🔎 Where can liens come from?

Some common examples may include:

• Mortgages — A lender generally has a lien against the property until the loan is satisfied and properly released.

• Tax Liens — Unpaid property taxes or certain other tax obligations may create liens against real estate.

• Judgment Liens — In certain circumstances, a court judgment against a property owner can affect their real property.

• Mechanic’s or Materialmen’s Liens — Unpaid contractors, subcontractors, or suppliers may have lien rights when labor or materials were provided for improvements to a property.

Why does this matter when buying or selling property?

Imagine purchasing a piece of property only to discover that an old debt or unreleased mortgage is still showing against the title. 😳

That’s one reason a title search is so important.

Before closing, title professionals research public records for mortgages, liens, judgments, taxes, and other recorded matters that could affect ownership or the transfer of the property.

And sometimes the debt has already been paid—the public record simply doesn’t contain the proper release. Even an old, satisfied obligation can create a title issue if the records haven’t been properly cleared.

📚 That’s where the research comes in.

Celebrate Melbourne !! 🍁 Come Shop Local, Support our Community, and Enjoy your Saturday !

It's time to Celebrate Melbourne again and planning has begun.

🍁"Fall Into Melbourne " on Saturday, October 3d, will combine the best of our Celebrate Melbourne event of sales and specials at local businesses, vendors, and food trucks--plus we're adding a chili cook-off on the court square, music, and a city-wide yard sale.

🍁This is an all-volunteer, no budget event, and there's no charge for vendor set up, though space is limited with the addition of the chili cook-off on the court square. We do need applications filled out, however, and they are available for pick up at Almost Heaven Flea Market in Melbourne.

🍁If you're a business that would like us to promote specials and sales you are having that day, please contact me so we can include you in our advertising.

🍁We'll have drawings for gift baskets throughout the day, and they'll be filled with items donated by local businesses, artisans, and individuals.
