My bank (Deutchebank) acted fraudulently selling my home with an active loan modification program in place claiming I missed the deadline. I DID NOT! I have emails as verification FROM the bank that docs were received. For a moment I had a fleeting memory that the bank is supposed to work with people during Covid and after with small businesses, and of course with disabilities. I am clear that they don't care since they're willing to hold me to a deadline date AND THROW ME OUT ON THE STREETS HOMELESS rather than work with me. This is unfair. Since day 1, Plaintiff has been unresponsive after repeated attempts at contacting them. When I have been able to reach them no one seems to know anything. I presumed that if I hired counsel it would be different. After a sale date was tried I hired her and she was good after years of trying later a chap13 to avoid foreclosure, & still no answer to my application, she quit. I filed chap13 (discharged 2020) only to avoid foreclosure since my LAWYER COULD NOT get anywhere and no answers from Deutchebank! Imagine how frustrating that is. I am a senior with a disability(filed) from a brain infection causing memory loss and neurological slowing in aptitude & motor functions. Saving all documentation as a habit I looked it over recently. Sadly, I never got an answer UNTIL the day of the sale, AT NOON, and STILL was not given a yes/no on the application. I have letters from PHH on behalf of DEUTCHEBANK as late as the 13th of October advising me to give them plenty of time to review the documents. I was fine with this, though in my last 3 emails, I requested information about the cancellation of the sale date, I asked will the sale be canceled since the sale date is the 17th of October. I wrote to them over 3 days with no response till the 17th at noon, the day of the sale. This is not fair as the basis of my argument. The bank never gave me an answer and the application was in process. These emails were sent to my PHH rep and the bank's counsel. They never replied. These past years I have learned that Deutchebank is notorious for these practices (see below). My research showed this illegal activity so I pressed them in emails asking when is the sale going to be cancelled for the bank to review documents. I even sent PHH these researched documents. I wanted them to know that I KNOW that this happens, since I worried about my home only feeling a little better after the plaintiff's counsel for PHH reassured me saying 'They are going to do the right thing with you John' They didn't and I was foreclosed. now my home is in the Bank's hands and I work every day to reverse this but after speaking to the lawyer who says I HAVE a case, but not strong enough his firm will take it so I gotta fall back to the only firm that wants my case. I did pull up the official papers to file and it's over my head!
Deutsche Bank PHH (The plaintiff) broke the law, apparently failing to communicate to the Defendant that the terminology in PHH's letters to him instead of "we will need time to review documents and someone will be in touch' to We reserve the right to lie to you, mislead you then set loose teams of Lawyers during a pandemic. Deutsche Bank uses government TARP funds any way we want but mainly for lawyers to expel you from your home because crushing dreams is what they do best, throwing people out of their homes & into TV boxes to live under a freeway! 19 years in my home should always be a factor signifying stability. I never want to move and remain available to communicate. Deutchebank & PHH simply do not care and NEVER intended to help though letting all of us know ‘we are here to help’. PLEASE choose a motto appropriate like ‘ruining people’s lives by throwing families out of their homes, 1 family at a time’.
The bank agreed to modify loans to struggling U.S. borrowers as part of a 2017 settlement. Instead, it’s receiving credit for financing new mortgages that likely would have been made anyway.
