Termination of Real Estate Contract in Florida

You’ve found your dream home, your offer was accepted, negotiated the best possible price, the contract is signed. Sometimes in life unexpected things happen. What are the possible ways to get out of contact?

Under Florida law a buyer and/or seller is able, under certain circumstances, to terminate a residential real estate contract and walk away from the deal without penalty. There are certain ways to do that:

1. Inspection
Could be serious issues came up with the property during the inspection process

2. Financing
Financing didn’t get approved.

3. Title problem
Could be that the title has some serious problems. If the seller is not able to deliver a clean title, the buyer may walk away from the sale.

4. Appraisal
If an appraisal comes in low, it can affect the amount of the approved loan. If the appraisal is less than the purchase price, the buyer can negotiate the price or pay the difference- or walk away.

5. Condo docs
If condo docs are not delivered on time

6. Denial from association
The association doesn’t approve- you can walk away.

Interest rates are expected to go up by the end of 2022. Mortgage rates are anticipated to rise to an average 3.3%, hitting around 3.6% by the end of 2022. That’s up from a low of 2.65% in the first week of January for 30-year fixed-rate loans.
