Title 18, sections 241 and 242 of the United States Code are federal criminal laws that prohibit certain types of civil rights violations:
Section 241
Prohibits conspiracy against the rights of citizens. This law makes it illegal for two or more people to conspire to threaten, oppress, or injure a person's constitutional or legal rights. It also makes it illegal to go in disguise to prevent someone from exercising their rights.
Section 242
Prohibits the deprivation of rights under color of law. This law makes it illegal for someone acting under the authority of the law to intentionally deprive a person of their constitutional or legal rights. This law does not require the offense to be motivated by racial bias or any other animus.
The punishment for violating these laws varies depending on the circumstances:
Section 241
A fine, up to ten years in prison, or both. If death results, or if the crime involves kidnapping, aggravated sexual abuse, or an attempt to kill, the punishment can be a fine, any term of years or life in prison, or the death penalty.
Section 242
A fine, up to one year in prison, or both. If the crime involves bodily injury, the use of a dangerous weapon, explosives, or fire, kidnapping, aggravated sexual abuse, or an attempt to kill, the punishment can be a fine, any term of years or life in prison, or the death penalty.
