INVITATION TO BID
The City of Middletown will receive sealed bids for:
Former O&W Middletown Station Rehabilitation & Restoration
Bids will be received by the City of Middletown Department of Public Works, 16 James St., Middletown, New York 10940 on September 2, 2025, until 3:30 P.M. local time and at same location on same date at 4:00 P.M. local time bids will be publicly opened and read aloud. Bids submitted by fax will not be accepted. Bids can be received the day before at the Department of Public Works office at the same address from 8:30 A.M. to 4: 30 P.M. The bid will include one (1) prime contract, Plumbing Contract (PC).
Copies of the Contract Documents may be examined free of charge at the following locations during regular business hours (8:30 A.M. to 4: 30 P.M.):

Copies of the above documents will be available at Fusco Engineering & Land Surveying, DPC located at 233 East Main Street Middletown, New York 10940 after July 30, 2025 between
9:00 A.M. – 4:00 P.M. upon deposit of $50.00 for each complete set. Checks for Contract Documents should be made payable to the City of Middletown. Deposits will be refunded to unsuccessful bidders, if the complete set of contract documents (in good condition) are returned within 14 days of the bid opening. Any non-bidder will not receive a refund.
All bidders are required to attend the pre-bid mandatory walkthrough of the site with the Project Engineer on August 12, 2025 at 11:00 A.M. on site at 2 Low Avenue, Middletown, New York 10940.
Written RFI’s are to be emailed to [email protected] and are due August 19, 2025, by 4:00 P.M.
Each bid must be accompanied by a certified check or bid bond from a domestic carrier licensed to do business in the State of New York in the amount of not less than five (10%) of the amount of the bid submitted.
Bidders on this work will be required to comply with the President's Executive Order Nos. 11246 and 11375 which prohibit discrimination in employment regarding race, creed, color, s*x, or national origin. § 356-12. Licenses and reciprocity.
All master plumbers performing the work described in §356-7, above, must be licensed in the City of Middletown. A master plumber is permitted to employ non licensed plumbers to assist the master plumber in performing business in the City of Middletown, or to display a sign or other advertisement in the City, before a license has been obtained pursuant to this chapter.
§ 356-13. Eligibility for license; examination; reciprocity.
Master plumbers licenses may only be issued to:
1. Persons who pass the examination as prescribed below in this article; or
2. Persons holding a masters plumbers license from another city or county in New York State who are approved for a Middletown license by the Commissioner of Public Works. Such persons may apply for a Middletown license by submitting proof of the out-of-City license, together with a financial and trade reference, and a listing of the largest five projects completed with contact information, to the Commissioner or his/her designee for evaluation. The Commissioner has sole discretion whether to approve or disapprove this application.
Statement of Non Collusion: Bidders on the contract are required to execute a non collusive bidding certificate pursuant to Section 103d of the General Municipal Law of the State of New York.
Security for Faithful Performance: The successful bidder will be required to furnish Performance and Labor and Material Payment Bonds written by firms licensed to do business in New York State, each in the amount of one hundred percent (100%) of the contract amounts in accordance with the provisions of the Contract Documents.
Sales and Use of Tax Exemptions: The City of Middletown is exempt from the payment of sales and compensation use taxes of the State of New York and of cities and counties on all materials, equipment, and supplies sold to the City of Middletown pursuant to this contract. Also exempt from such taxes are purchases by the Contractor and his Subcontractors of materials, equipment, and supplies to be sold to the City of Middletown pursuant to this contract, including tangible personal property to be incorporat¬ed in any structure, building or other real property forming part of the project. These taxes are not to be included in the Bid.
Prevailing Wage: This is a prevailing wage project Davis Bacon prevailing wage schedules enclosed in bid package. MWBE goal 30% in accordance with HUD Section 3 SDVOB (encouraged), sustainable construction practices, (strongly encouraged), details in bid package.
All bids shall be binding for a period of forty five (45) days after the bid opening and may be extended with the permission of both parties. The City of Middletown reserves the right to reject any and all bids and to waive any informalities therein.
Equal Opportunity Requirements and Procedures. Under Article 15A of the New York State Executive Law, all award recipients and their contractors are required to comply with the Equal Employment Opportunity provisions of Section 312 of that Article. Also, all contractors and awardees are required to make affirmative efforts to ensure that New York State Certified Minority and Women-Owned Business Enterprises are afforded opportunities for meaningful participation in projects through inclusion on the list of contractors funded by HTFC pursuant to Section 313 of the Article.
