PSA: Living Trusts 🏡📜

Parents, if you have a living revocable trust, please be open with your children about what it states, what your wishes are, and—if you don’t give them a copy—where the original and copies can be found.

And NEVER throw away your original trust documents, even after you make amendments! Keep the original documents and all amendments together in a safe place.

Hawaii real estate can be especially complicated because Hawaii has TWO separate recording systems. The ONLY one in the country!

When a property is being sold, the title company conducts a rigorous review of the property’s history. If a trust is involved, they may need to verify the trust documents and follow the chain of title, which can require going back to the original trust, even if it was amended years ago. Many people simply don’t realize this.

Parents, you can unintentionally create a lot of problems for your children if they inherit property but don’t have the information or documents they need. ❤️

The trust you created is supposed to help protect your family and make things easier for them after you’re gone. Don’t leave them searching for important documents or trying to piece together your wishes.

And one more important point: work with an attorney who is experienced in estate planning AND knowledgeable about Hawaii’s unique real estate recording system. I’ve encountered situations where an attorney was not familiar with the differences between Hawaii’s two recording systems, and the estate planning documents did not provide the protection the family expected.

Do your research. Ask questions. Make sure your estate-planning attorney understands Hawaii real estate and both recording systems.

A little preparation now can save your family a tremendous amount of stress later. 🙏🏼❤️
