One of the remaining provisions of the CARES Act is the 30-day Notice to Vacate that is required for properties that are federally backed (e.g., Section 8 properties, properties financed by a Fannie Mae- or Freddie Mac-backed loan, etc.). This section did not expire when the CARES Act eviction moratorium did over two years ago. It should have, but because of the way the CARES Act was drafted, it did not. Fortunately, Congressman Barry Loudermilk has introduced the Respect State Housing Laws Act, which would end the federal 30-day notice to vacate and return landlord-tenant to its pre-pandemic posture as a function of state law.
