Morning-
I took the BIC-Update yesterday and wanted to share a couple of things. Granted, we all know this stuff, but I'm always reminded of a few things during these classes.

1. Receipt of DD fee is stated on the OTP as to be delivered at Effective Date.
2. Effective Date is defined as "the last dated signature on the OTP" PLUS "Communication of the signature to the other party."
3. EMD and DD fee are not "essential" elements of the contract. Once we have signatures from all parties and have communicated this to all parties...we are under contract.
4. Most all Firms are using some type of digital signature system......the #1 complaint from the buying and selling public (when they get upset about things) is that they didn't understand what they were signing. I suggest we adopt a reiteration of the terms of the OTP and LC in the body of the email when we send over the OTP or LC. I will make a template for us to use and upload it to appfiles and here in the files section.
5. Wire Instruction Fraud is still rampant and we should incorporate an initial section by the "Wire Fraud" section of the OTP and LC. I will ask appfiles to embed this additional initial in the forms...this way ya'll don't have to do an additional step.
