Re: Covenant, Restrictions, By-Laws, and Policies of the Chestnut Tree Townhomes Association (Summary).
This document is being provided as an abridged version of the Protective covenant and Bylaws of the Chestnut Tree Townhomes Association. A full copy of the covenant is available at the Monongalia County Court House. Every owner and occupant must abide by the covenant, restrictions, by-laws, and policies and to pay the association fee. The board has the ability to enforce the covenant, restrictions, by-laws and policies to all owners, occupants, and visitors of the properties. The board may do so in the form of (but not limited to): fines, liens, suspension of right of use of right of ways, streets or common areas, suspension of rights and/or banning from the property.
Covenant restrictions, by-laws and policies summary are as follows:
1. The property can only be used for residential housing – no business. Each lot can only be used as a residence for a single family/person and for no other purpose. Housing is to be used only for single-family/person housing and NOT to numbers of college students. Housing is for owner occupancy only and shall not be used for rental or booking such as “Airbnb” or the like.
2. No activity may interfere with the quiet enjoyment or comfort of any other occupant. No noisiness or offensive activity is allowed on any lot. Any activity that either willfully or negligently may be or become an annoyance or nuisance to the other owners is prohibited. Noise or inappropriate behavior will NOT be tolerated and will result in action against the offending party by the board. For example, it is expected that occupants refrain from loud interactions on the balconies or garages as the noise would interfere with other occupant’s quiet enjoyment or comfort.
3. There shall be no obstruction of right of ways. Parking is only permitted in the following areas: one spot in front of each townhouse, and two spots behind each townhouse. Parking in any other area would be considered a common area and result in towing for which the offending party would be monetarily responsible.
4. Each owner is obligated to maintain and keep his/her lot in good upkeep and maintenance and repair. Gutters and roof are responsibility of the owners. Shrubbery outside front of homes is the homeowner’s responsibility. Weeding and care of individual property are the homeowner’s responsibility. If the owner does not maintain the property, the board has the right to perform the maintenance at the owner’s expense.
5. Nothing may be altered or constructed or renovated in or on or removed from any lot except upon written consent of the board. Any homeowner wishing to change the construction of the balcony must follow the specifications of the approved design (for design example see townhomes 9, 10, 30, 31, and 39 and 40). Home colors and schemes CANNOT be changed from the original design without board approval, this includes but is not limited to paint colors, roof shingle colors, door, window, and shutter designs and colors. Homeowners may repaint front the same original approved color however color or design changes need prior board approval.
6. Owners may not cause or permit anything to be hung or displayed on the outside of windows or placed on the outside walls of the building other than seasonal decorations. No radio or television antenna or satellite dishes may be placed on or affixed to any exterior wall or roof or part thereof without prior consent of the association. “For Sale” signs or other window displays, or advertising are not permitted on any part of the property or in any lot therein. The signs may only be displayed in the window of the property.
7. Any pet causing a nuisance or unreasonable disturbance shall be permanently removed from the property upon 30 days notice from the association.
8. No clothing, blankets, laundry of any kind or other articles of any kind may be hung out or exposed on any part of the lot unless otherwise determined by the association. The lot must be kept free of rubbish, debris, and other unsightly materials.
9. Garbage is only to be disposed of in the approved areas (dumpsters at end of row). Any and all large items, such as appliances, carpets, mattresses and so on require a fee to be paid to be removed. Homeowners must contact the waste management company (phone number located on the dumpsters) for removal of these items and the homeowner must pay the required fee. These items are NOT to be placed at the garbage disposal area (dumpsters) as they will require the fee to be paid prior to removal.
10. Detailed plans for reconstruction, rebuilding, or improvement of any dwelling or any other structure must be submitted to the association at least 4 weeks before the intended date for commencing construction. The decision of the association shall be binding. A copy of the said plans and specifications is to be filed with the association, its successors, and assigns.
11. Any violation of these restrictions will result in legal action from the board in the form of (but not limited to): fines, liens, and suspension of right of use of right of ways, streets or common areas, suspension of voting rights and/or banning from entire property.
