A lot of people assume that if your name is on the mortgage (deed of trust), you automatically own the home. But that’s not always the case.

Your mortgage and your deed serve two different purposes:
🏡 The mortgage is your loan.
📄 The deed determines legal ownership.

That means someone can be:
• On the loan but not on title
• On title but not on the loan
• On both

Understanding who’s on title can make a big difference when it comes to selling a home, refinancing, divorce, or inheritance.

One of the biggest surprises we see at closing?
“I’ve been divorced for years. My ex doesn’t have to sign... right?”
Not necessarily.
A lot of people assume that once the divorce is final, their former spouse is automatically removed from title. But that’s not always how it works.
A divorce decree doesn’t automatically change the public land records. If a new deed was never recorded, your ex may still have to sign documents before the property can be sold.
Every situation is different, which is why it’s so important to have your title company review ownership early in the transaction. Catching these issues upfront can save everyone from delays and last-minute scrambling.
