Did you know there may be an expedited and cost efficient alternative to going through the Court process for the probate/succession process to transfer the assets of a decedent. In Louisiana, if the estate of the decedent is valued at less than $125,000, you may qualify to use the Affidavit of Small Succession to transfer assets, completely circumventing the Court process. This affidavit, once executed properly, can be simply filed at the land records office for as little as $100-$200 in the parish or county in which you live. We understand the challenges, especially in the current economy, that many are facing and the lack of access many individuals have to the legal system.

In an April 2023 United Supreme Court Decision the SCOTUS would rule, in Tyler v Hennepin County, that the retaining of equity by municipalities in the seizure and sale of immovable property for purposes of delinquent property taxes is considered a “taking” pursuant to the Takings Clause set forth in the 5th amendment of the US Constitution.

This means, for example, if a resident’s property was seized and sold at an auction by a specific municipality for delinquent property taxes in the amount $10,000. However, the property sold at the auction for $50,000. That the excess $40,000 being retained by municipalities subsequent to the sale of the subject property is unconstitutional and a violation of the takings clause of the 5th amendment of the United States Constituiton.

This is a major win for property owners across the country and even here in the City of New Orleans, the municipality continues to unlawfully retain the excess equity of property owners in seizures and sales of immovable property.

Maybe now the City of New Orleans can stop stealing the money , i.e. the equity, of the property belonging to residents of this City and atleast pay them the overages received from the SOAP auctions conducted by civic source. Please know, that if your property goes to a Sale of Adjudicated Property Auction, the surplus amount above and beyond what’s owed by the tax debtor, must now be returned to the property owner. Before this ruling by the Supreme Court, the City of New Orleans literally kept the residents overages and to my knowledge they still are, as this ruling just came down in May of 2023.
