Here’s a good rule of thumb for folks looking to utilize a 1031 tax deferred exhange.

A 1031 exchange is one of the most powerful tools land investors utilize and you have 180 calendar days to complete one. Below is what most don’t understand.

Here’s a plain-language breakdown of how we’ve used it to help Iowa landowners defer capital gains and scale their land holdings:

🕰️ The 45-day rule: Beginning the day after closing on your relinquished property, you have 45 calendar days to identify your replacement property utilizing one of the following options, the 3 property rule, the 200% rule or the 95% rule. Failure to identify in this time frame and your 1031 in null and void.

🕰️ The 180-day rule: Following the 45-day identification period you must close on the replacement property(s) within 135 calendar days giving you a total of 180 calendar days to fully execute your 1031. These deadlines are set in stone; with limited options for an extension. However If your agent is good enough, a 1031 exchange doesn’t have to take months. With the right preparation, you can sell your relinquished property and close on the replacement in as little as a week. It all comes down to having both sides aligned before the first deal closes.  

💡What most people miss: The replacement property must be ‘like-kind’; but in real estate, that’s broad. A crop farm can be exchanged into a hunting property. A pasture can become a development parcel.

💡The income math: Deferring $500K in capital gains taxes at a 20% rate means $500K more working for you in the replacement property. The compounding effect over 10 years is significant.

CRP — Conservation Reserve Program — is one of the most misunderstood income sources in farmland investing.

Here’s what serious buyers need to know:

💰 What it pays: CRP contracts pay landowners annual rental income to keep environmentally sensitive land out of crop production. Rates vary by county and practice but can range from $100–$300+ per acre annually.

📅 What the contracts look like: Typically 10–15 year contracts with USDA. Existing contracts transfer with the land sale — meaning a buyer often acquires guaranteed income from day one.

🦌 The recreational bonus: CRP ground is some of the best wildlife habitat in the Midwest. Established CRP fields are deer magnets — they function as bedding cover, travel corridors, and thermal protection.

⚠️ What to watch: Contracts approaching expiration create a decision point — re-enroll or return to crop production. Both paths have value implications worth modeling.
