Once again the City Council is using a chain saw where a scalpel is required. There are many many 'no fee' apartments, as much as 60%, on the market, generally offered by larger landlords and developers who build those prices into the overall budget.

Smaller landlords are struggling as it is, to maintain their buildings as safe and secure and comfortable buildings for their tenants, many many who are paying below market rates under rent control or rent stabilization. At the same time, brokers play an important role helping both landlords with marketing and processing applications, and tenants with searching and applying.

We brokers have to make a living, and these fees, related to typical hours spent per client, aren't unreasonable. This decision will force landlords to raise rents to cover these costs, and/or reduce the efficiency of the market - both of which accrue to negative impacts on prospective renters, and the larger challenge of lack of inventory.

A better solution would be a trickle-up model: rent subsidies for working and middle class New Yorkers to phase out rent controls and stabilize pricing, affordability, and maintenance of thousands of aging buildings throughout the city. This would stimulate the housing market, allow renters to have more spending money for other local businesses, and allow landlords to maintain their properties and pay their brokers.

This could also open up the possibility that more folks can live near their work, reducing demand on public transit and improving street life, further stimulating the micro- and macro-local economies.
