A Title Company Is Not Required to Protect You. An Attorney Is.
Here's something every buyer should know: a title company is not necessarily your advocate. Under a 2012 Rhode Island Superior Court case, title companies acting as settlement agents have no fiduciary duty to you. They're hired only to confirm the status of title and issue title insurance—nothing more. They aren't required to explain risks, review your contract, or guide you through decisions, because legally they're only doing "title and settlement," not representing you as your attorney.
But having your own buyer's attorney is different.
An attorney is legally bound to act in your best interest. That means protecting your rights, reviewing documents with your goals in mind, and giving you real legal advice throughout the process. Even when a transaction feels simple, advocacy still matters. Most of the work happens quietly: checking contract language, spotting issues before they become problems, and keeping the process on track with tact and clarity.
It's not about just processing paperwork, it's about offering advice and being an advocate. It's not about just following a checklist, it's about understanding the common pitfalls and working to prevent them.
